S.F. 2411 DIVISION I 1 REGIONAL INDUSTRY SECTOR PARTNERSHIPS AND STATEWIDE WORK-BASED 2 LEARNING INTERMEDIARY NETWORK 3 Section 1. Section 84A.5, subsection 5, paragraph f, Code 4 2024, is amended by striking the paragraph. 5 Sec. 2. Section 85.61, subsection 3, paragraph c, Code 2024, 6 is amended to read as follows: 7 c. An eligible postsecondary institution as defined in 8 section 261E.2 , a school district, or an accredited nonpublic 9 school if a student enrolled in the eligible postsecondary 10 institution, school district, or accredited nonpublic school 11 is providing unpaid services under a work-based learning 12 opportunity offered in accordance with section 84A.16 . 13 However, if the student participating in a work-based learning 14 opportunity is participating in open enrollment under section 15 282.18 , “employer” means the receiving district. 16 Sec. 3. Section 85.61, subsection 12, paragraph a, 17 subparagraphs (4) and (5), Code 2024, are amended to read as 18 follows: 19 (4) A student enrolled in a school district or accredited 20 nonpublic school who is participating in a work-based learning 21 opportunity offered in accordance with section 84A.16 . 22 (5) A student enrolled in a community college as defined in 23 section 260C.2 , who is participating in a work-based learning 24 opportunity offered in accordance with section 84A.16 that is 25 offered by the community college. 26 Sec. 4. Section 256.125, subsections 6 and 9, Code 2024, are 27 amended by striking the subsections. 28 Sec. 5. Section 256.133, subsections 2 and 3, Code 2024, are 29 amended by striking the subsections. 30 Sec. 6. Section 256.136, subsection 1, paragraph e, Code 31 2024, is amended by striking the paragraph. 32 Sec. 7. Section 256.136, subsection 4, paragraph d, Code 33 2024, is amended by striking the paragraph. 34 Sec. 8. Section 256.136, subsection 4, paragraph f, Code 35 -1- LSB 5175SZ (2) 90 jda/jh 1/ 15

Representatives of business and industry , including 2 representatives of regional industry sector partnerships 3 established pursuant to section 84A.15 . 4 Sec. 9. REPEAL. Sections 84A.15 and 84A.16, Code 2024, are 5 repealed. 6 Sec. 10. STATEWIDE WORK-BASED LEARNING INTERMEDIARY NETWORK 7 FUND. Any moneys appropriated to the department of workforce 8 development for purposes of the statewide work-based learning 9 intermediary network fund established pursuant to section 10 84A.16 that remain unencumbered or unobligated as of July 1, 11 2024, shall be deposited in the general fund of the state. 12 DIVISION II 13 CAREER AND TECHNICAL EDUCATION AND WORK-BASED LEARNING 14 Sec. 11. Section 256.11, subsection 5, paragraph h, 15 subparagraph (2), Code 2024, is amended to read as follows: 16 (2) Instructional programs provided under subparagraph 17 (1) shall comply with the provisions of subchapter VII, part 18 2 , relating to career and technical education, and shall be 19 articulated with postsecondary programs of study and include 20 field, laboratory, or on-the-job training , or work-based 21 learning, as defined in section 256.125 . Each sequential 22 unit shall contain a portion of a career and technical 23 education program approved by the department. Standards for 24 instructional programs shall include but not be limited to new 25 and emerging technologies; job-seeking, job-adaptability, and 26 other employment, self-employment and entrepreneurial skills 27 that reflect current industry standards and labor-market needs; 28 and reinforcement of basic academic skills. Instructional 29 programs that include work-based learning may be provided when 30 school is not in session, including but not limited to during 31 the summer months. 32 Sec. 12. Section 256.146, Code 2024, is amended by adding 33 the following new subsection: 34 NEW SUBSECTION . 25. By September 1, 2024, adopt rules 35 -2- LSB 5175SZ (2) 90 jda/jh 2/ 15
S.F. 2411 pursuant to chapter 17A establishing endorsements for 1 instruction related to career and technical fields in schools 2 providing instruction to students enrolled in prekindergarten 3 through grade twelve, including but not limited to business, 4 agriculture, industrial technology, consumer science, and 5 information technology. 6 Sec. 13. EMERGENCY RULES. The board of educational 7 examiners may adopt emergency rules under section 17A.4, 8 subsection 3, and section 17A.5, subsection 2, paragraph “b”, 9 to implement the provisions of this division of this Act and 10 the rules shall be effective immediately upon filing unless 11 a later date is specified in the rules. Any rules adopted 12 in accordance with this section shall also be published as a 13 notice of intended action as provided in section 17A.4. 14 Sec. 14. EFFECTIVE DATE. This division of this Act, being 15 deemed of immediate importance, takes effect upon enactment. 16 DIVISION III 17 STUDENT TEACHING 18 Sec. 15. Section 256.16, subsection 1, paragraph c, Code 19 2024, is amended to read as follows: 20 c. (1) Require that each student admitted to an approved 21 practitioner preparation program participate in pre-student 22 teaching field experiences that include both observation and 23 participation in teaching activities in a variety of school 24 settings. 25 (a) Pre-student teaching field experiences for students 26 participating in an initial teacher preparation program shall 27 comprise a total of at least eighty hours in duration, at least 28 ten hours of which shall occur prior to a student’s acceptance 29 in an approved practitioner preparation program. 30 (b) Pre-student teaching field experiences for students 31 participating in a teacher intern preparation program shall 32 comprise a total of at least fifty hours in duration. The 33 (2) Require that the student teaching experience shall be 34 a minimum of fourteen weeks in duration during the student’s 35 -3- LSB 5175SZ (2) 90 jda/jh 3/ 15
S.F. 2411 final year of the practitioner preparation program. 1 (a) A student shall be credited a minimum of one week, 2 but not more than ten weeks, of prior work experience as 3 a substitute teacher or a para-educator, including prior 4 experience under the teacher and para-educator registered 5 apprenticeship grant program, toward the requirements 6 associated with the fourteen-week student teaching experience, 7 if all of the following requirements are satisfied: 8 (i) The board of educational examiners has issued 9 a substitute license, substitute authorization, or a 10 para-educator certificate to the student. 11 (ii) The student’s prior work experience took place in 12 the classroom of a cooperating teacher who is appropriately 13 licensed in the subject area and grade level endorsement for 14 which the student is being prepared. 15 (iii) The student bears the primary responsibility for 16 planning, instruction, and assessment within the classroom 17 during the student teaching experience. 18 (b) A student shall be credited a minimum of one week, 19 but not more than fourteen weeks, of work experience as a 20 para-educator toward the requirements associated with the 21 fourteen-week student teaching experience, if all of the 22 following requirements are satisfied: 23 (i) The board of educational examiners has issued a 24 para-educator certificate to the student. 25 (ii) The student works as a para-educator for at least 26 one-half of each school day during the student teaching 27 experience. 28 (iii) The student’s work experience takes place in the 29 classroom of a cooperating teacher who is appropriately 30 licensed in the subject area and grade level endorsement for 31 which the student is being prepared. 32 (iv) The student bears the primary responsibility for 33 planning, instruction, and assessment within the classroom 34 during the student teaching experience. 35 -4- LSB 5175SZ (2) 90 jda/jh 4/ 15
S.F. 2411 (3) The program shall make every reasonable effort to offer 1 the student teaching experience prior to a student’s last 2 semester, or equivalent, in the program, and to expand the 3 student’s student teaching opportunities beyond one semester 4 or the equivalent. 5 DIVISION IV 6 CHANGES TO DEFINED TERMS 7 Sec. 16. Section 84D.2, subsections 18, 24, and 25, Code 8 2024, are amended by striking the subsections and inserting in 9 lieu thereof the following: 10 18. “Quality pre-apprenticeship program” means a program 11 or set of strategies, registered by and for purposes of the 12 Iowa office of apprenticeship, including basic skills training, 13 academic skills remediation, or introduction to the industry, 14 designed to prepare individuals for entry into a registered 15 apprenticeship program. 16 24. “Work-based learning” means opportunities and 17 experiences that include but are not limited to sustained 18 project-based learning in partnership with an employer, 19 simulated work experiences aligned with industry-recognized 20 credentials, high-quality pre-apprenticeships aligned to an 21 apprenticeship, student learner programs, internships, and 22 apprenticeships. 23 25. “Youth apprenticeship” , for purposes of the Iowa 24 office of apprenticeship, means a program that is designed 25 specifically for an apprentice eighteen years of age or under. 26 Sec. 17. Section 256.125, subsection 8, Code 2024, is 27 amended to read as follows: 28 8. “Work-based learning” means opportunities and 29 experiences that include but are not limited to tours, 30 job shadowing, rotations, mentoring, entrepreneurship, 31 service learning, sustained project-based learning in 32 partnership with an employer, simulated work experiences 33 aligned with industry-recognized credentials, high-quality 34 pre-apprenticeships aligned to an apprenticeship, student 35 -5- LSB 5175SZ (2) 90 jda/jh 5/ 15
S.F. 2411 learner programs, internships, and apprenticeships. 1 Sec. 18. EFFECTIVE DATE. The following, being deemed of 2 immediate importance, take effect upon enactment: 3 1. The portion of the section of this division of this Act 4 amending section 84D.2, subsection 18. 5 2. The portion of the section of this division of this Act 6 amending section 84D.2, subsection 25. 7 DIVISION V 8 DEPARTMENT OF WORKFORCE DEVELOPMENT —— WORKFORCE OPPORTUNITY 9 FUND 10 Sec. 19. NEW SECTION . 84A.20 Workforce opportunity fund. 11 1. A workforce opportunity fund is created in the 12 state treasury as a separate fund under the control of 13 the department of workforce development. The fund shall 14 consist of appropriations made to the fund, any other moneys 15 available to and obtained or accepted by the department from 16 the federal government or private sources for placement in 17 the fund, and transfers of interest, earnings, and moneys 18 from other funds as provided by law. Moneys in the fund are 19 appropriated to the department of workforce development for 20 the purposes of training and infrastructure related to the 21 growth and maintenance of the state’s workforce programs. 22 Permitted uses of the moneys in the fund include but are not 23 limited to equipment, instructional materials, stipends, and 24 other training-related costs. The department of workforce 25 development shall only distribute moneys in the fund to 26 workforce programs located within this state. 27 2. Annually, on or before December 31 of each year, the 28 department of workforce development shall submit a report 29 to the general assembly and the legislative services agency 30 that contains a list of all expenditures from the workforce 31 opportunity fund made in the previous fiscal year. The 32 legislative services agency shall provide a copy of the 33 report to the co-chairpersons and ranking members of the joint 34 appropriations subcommittee on economic development. 35 -6- LSB 5175SZ (2) 90 jda/jh 6/ 15

Notwithstanding section 8.33, moneys in the workforce 1 opportunity fund that remain unencumbered or unobligated 2 at the close of the fiscal year shall not revert but shall 3 remain available for expenditure for the purposes designated 4 for subsequent fiscal years. Notwithstanding section 12C.7, 5 subsection 2, interest or earnings on moneys in the fund shall 6 be credited to the fund. 7 Sec. 20. Section 96.9, subsection 8, Code 2024, is amended 8 by striking the subsection. 9 Sec. 21. UNEMPLOYMENT COMPENSATION RESERVE FUND —— TRANSFER 10 TO WORKFORCE OPPORTUNITY FUND. 11 1. Any moneys appropriated to the department of workforce 12 development for purposes of the unemployment compensation 13 reserve fund established pursuant to section 96.9 that 14 remain unencumbered or unobligated as of July 1, 2024, but 15 not more than thirty million dollars, shall be deposited in 16 the workforce opportunity fund created in section 84A.20, if 17 enacted by this division of this Act. 18 2. Any moneys remaining in the unemployment compensation 19 reserve fund after the deposit described in subsection 1 shall 20 be transferred to the account of this state in the unemployment 21 trust fund; provided, however, that any interest earned on 22 moneys remaining in the unemployment compensation reserve 23 fund after the deposit described in subsection 1 shall be 24 transferred to the special employment security contingency 25 fund. 26 DIVISION VI 27 FUTURE READY IOWA SKILLED WORKFORCE LAST-DOLLAR SCHOLARSHIP 28 PROGRAM 29 Sec. 22. Section 256.228, subsection 1, paragraph f, Code 30 2024, is amended to read as follows: 31 f. “Eligible program” means a any of the following: 32 (1) A program of study or an academic major jointly approved 33 by the commission and the department of workforce development, 34 in consultation with an eligible institution, that leads to a 35 -7- LSB 5175SZ (2) 90 jda/jh 7/ 15
S.F. 2411 credential aligned with a high-demand job designated by the 1 workforce development board or a community college pursuant to 2 section 84A.1B, subsection 14 . If the board or a community 3 college removes a high-demand job from a list created under 4 section 84A.1B, subsection 14 , an eligible student who received 5 a scholarship for a program based on that high-demand job 6 shall continue to receive the scholarship until achieving 7 a postsecondary credential, up to an associate degree, as 8 long as the student continues to meet all other eligibility 9 requirements. 10 (2) A program of study or an academic major jointly approved 11 by the commission and the department of workforce development 12 that leads to a credential aligned with at least one of ten 13 priority in-demand fields designated by rule adopted by the 14 workforce development board. If the board discontinues the 15 designation of a previously designated priority in-demand 16 field, an eligible student who received a scholarship for a 17 program based on the designation of that priority in-demand 18 field shall continue to receive the scholarship until achieving 19 a postsecondary credential, up to an associate degree, as 20 long as the student continues to meet all other eligibility 21 requirements. 22 Sec. 23. Section 256.228, subsection 1, paragraph g, Code 23 2024, is amended by adding the following new subparagraph: 24 NEW SUBPARAGRAPH . (5) Has an expected family contribution 25 of less than or equal to twenty thousand dollars, as determined 26 by the free application for federal student aid. 27 Sec. 24. Section 256.228, subsection 4, paragraph b, Code 28 2024, is amended to read as follows: 29 b. Adopt rules under chapter 17A , in collaboration with the 30 department of workforce development, for administration of this 31 section , including but not limited to establishing rules that 32 do all of the following: 33 (1) Establish the duties and responsibilities of eligible 34 institutions under the program ; defining . 35 -8- LSB 5175SZ (2) 90 jda/jh 8/ 15
S.F. 2411 (2) Define residence and satisfactory academic progress for 1 purposes of the program ; and establishing . 2 (3) Establish procedures for scholarship application, 3 processing, and approval. The rules shall provide for 4 determining 5 (4) Determine the priority awarding of scholarships if 6 funds available for purposes of this section are insufficient 7 to pay all eligible students. Priority shall be given to fully 8 awarding each eligible student approved for a scholarship 9 rather than to prorating scholarship awards among all eligible 10 students. 11 (5) Determine the annual amount of a future ready Iowa 12 skilled workforce last-dollar scholarship, not to exceed 13 the limitations established in subsection 3, based on the 14 type of eligible program in which the eligible student is 15 participating. The rules shall provide that eligible students 16 who are enrolled in eligible programs described in subsection 17 1, paragraph “f” , subparagraph (2), shall be eligible for 18 larger maximum annual amounts of future ready Iowa skilled 19 workforce last-dollar scholarships than eligible students who 20 are enrolled in eligible programs described in subsection 1, 21 paragraph “f” , subparagraph (1). 22 Sec. 25. Section 256.228, subsection 4, Code 2024, is 23 amended by adding the following new paragraph: 24 NEW PARAGRAPH . e. Following the approval of eligible 25 programs in subsection 1, paragraph “f” , annually establish a 26 two-year budget that shows amounts the commission expects to 27 expend on Iowa skilled workforce last-dollar scholarship awards 28 under this section for all eligible students who are enrolled 29 in the approved eligible programs. 30 Sec. 26. Section 256.228, Code 2024, is amended by adding 31 the following new subsection: 32 NEW SUBSECTION . 4A. Scholarship awards —— reductions. The 33 commission may ratably reduce scholarship awards to more 34 closely align with the funds the general assembly has 35 -9- LSB 5175SZ (2) 90 jda/jh 9/ 15
S.F. 2411 appropriated for purposes of this section. 1 Sec. 27. EMERGENCY RULES. The college student aid 2 commission and the department of workforce development may 3 adopt emergency rules under section 17A.4, subsection 3, and 4 section 17A.5, subsection 2, paragraph “b”, to implement the 5 provisions of this division of this Act and the rules shall 6 be effective immediately upon filing unless a later date is 7 specified in the rules. Any rules adopted in accordance with 8 this section shall also be published as a notice of intended 9 action as provided in section 17A.4. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to work-based learning, including by 14 repealing provisions related to regional industry sector 15 partnerships and the statewide work-based learning intermediary 16 network, establishing the workforce opportunity fund within 17 the department of workforce development (IWD), and modifying 18 provisions related to career and technical education, student 19 teacher requirements for students with substitute teaching or 20 para-educator experience, the unemployment compensation reserve 21 fund, and the future ready Iowa skilled workforce last-dollar 22 scholarship program. 23 DIVISION I —— REGIONAL INDUSTRY SECTOR PARTNERSHIPS AND 24 STATEWIDE WORK-BASED LEARNING INTERMEDIARY NETWORK. Code 25 section 84A.15 authorizes community colleges and IWD to use 26 moneys for the pathways for academic career and employment 27 program to provide staff and support for the development and 28 implementation of a regional industry sector partnership within 29 each region served by each community college. The bill repeals 30 Code section 84A.15 and makes conforming changes. 31 Code section 84A.16 establishes the statewide work-based 32 learning intermediary network program within IWD for the 33 purpose of preparing students for the workforce by facilitating 34 cooperation and collaboration between businesses and entities 35 -10- LSB 5175SZ (2) 90 jda/jh 10/ 15
S.F. 2411 within the state system of education and offering relevant, 1 work-based learning activities to students and teachers. The 2 bill repeals Code section 84A.16 and makes conforming changes. 3 DIVISION II —— CAREER AND TECHNICAL EDUCATION AND WORK-BASED 4 LEARNING. Current law requires school districts and accredited 5 nonpublic schools to offer and teach, in grades 9 through 12, 6 a minimum of three sequential units in at least four career 7 and technical education service areas. The bill provides 8 that the instructional programs provided under this provision 9 may include work-based learning, as defined in Code section 10 256.125 (community colleges and post-secondary readiness 11 bureau), as modified by the bill. The bill also provides that 12 instructional programs that include work-based learning may be 13 provided when school is not in session, including during the 14 summer months. 15 The bill requires the board of educational examiners to 16 adopt rules by September 1, 2024, establishing endorsements for 17 instruction related to career and technical fields in schools 18 providing instruction to students enrolled in prekindergarten 19 through grade 12. The bill authorizes the board of educational 20 examiners to adopt emergency rules to implement these 21 provisions. 22 The bill provides that this division takes effect upon 23 enactment. 24 DIVISION III —— STUDENT TEACHING. Current law provides that 25 the student teaching experience provided during a practitioner 26 preparation program shall be a minimum of 14 weeks in duration 27 during the student’s final year of the program. The bill 28 provides that a student shall be credited a minimum of 1 week, 29 but not more than 10 weeks, of prior work experience as a 30 substitute teacher or a para-educator toward the requirements 31 associated with the 14-week student teaching experience, if the 32 board of educational examiners has issued a substitute license 33 or authorization or a paraeducator certificate to the student, 34 the student’s prior work experience took place in the classroom 35 -11- LSB 5175SZ (2) 90 jda/jh 11/ 15
S.F. 2411 of a cooperating teacher who is appropriately licensed, and 1 the student bears the primary responsibility for planning, 2 instruction, and assessment within the classroom during the 3 student teaching experience. Additionally, the bill provides 4 that a student shall be credited a minimum of 1 week, but not 5 more than 14 weeks, of work experience as a para-educator 6 toward the requirements associated with the 14-week student 7 teaching experience, if the board of educational examiners has 8 issued a para-educator certificate to the student, the student 9 works as a para-educator for at least one-half of each school 10 day during the student teaching experience, the student’s 11 work experience takes place in the classroom of a cooperating 12 teacher who is appropriately licensed, and the student bears 13 the primary responsibility for planning, instruction, and 14 assessment within the classroom during the student teaching 15 experience. 16 DIVISION IV —— CHANGES TO DEFINED TERMS. The bill modifies 17 the definition of “work-based learning” for purposes of 18 the Iowa registered apprenticeship Act, and for purposes of 19 the community colleges and post-secondary readiness bureau 20 within the higher education division of the department of 21 education, to mean opportunities and experiences that include 22 but are not limited to sustained project-based learning in 23 partnership with an employer, simulated work experiences 24 aligned with industry-recognized credentials, high-quality 25 pre-apprenticeships aligned to an apprenticeship, student 26 learner programs, internships, and apprenticeships. 27 The bill also modifies the definitions of “quality 28 pre-apprenticeship program” and “youth apprenticeship” for 29 purposes of the Iowa registered apprenticeship Act. The bill 30 provides that the modifications to the definitions of “quality 31 pre-apprenticeship program” and “youth apprenticeship” take 32 effect upon enactment. 33 DIVISION V —— DEPARTMENT OF WORKFORCE DEVELOPMENT —— 34 WORKFORCE OPPORTUNITY FUND. The bill establishes a workforce 35 -12- LSB 5175SZ (2) 90 jda/jh 12/ 15

The bill provides that 17 the legislative services agency is to provide a copy of the 18 report to the co-chairpersons and ranking members of the joint 19 appropriations subcommittee on economic development. 20 The bill provides that any moneys appropriated to IWD 21 for purposes of the unemployment compensation reserve fund 22 that remain unencumbered or unobligated as of July 1, 2024, 23 but not more than $30 million, shall be deposited in the 24 workforce opportunity fund. Additionally, the bill provides 25 that any moneys remaining in the unemployment compensation 26 reserve fund after such deposit shall be transferred to the 27 account of this state in the unemployment trust fund; provided, 28 however, that any interest earned on moneys remaining in the 29 unemployment compensation reserve fund after the deposit are to 30 be transferred to the special employment security contingency 31 fund. The bill strikes Code section 96.9(8) (unemployment 32 compensation reserve fund). 33 DIVISION VI —— FUTURE READY IOWA SKILLED WORKFORCE 34 LAST-DOLLAR SCHOLARSHIP PROGRAM. Current law provides that 35 -13- LSB 5175SZ (2) 90 jda/jh 13/ 15
S.F. 2411 eligible students may receive a future ready Iowa skilled 1 workforce last-dollar scholarship from the future ready 2 Iowa skilled workforce last-dollar scholarship fund. The 3 scholarship is intended to cover any remaining gap between 4 federal and state grants or scholarships and tuition and 5 certain fees. Under current law, only an “eligible student” 6 participating in an “eligible program”, defined as a program 7 of study or an academic major jointly approved by the college 8 student aid commission and the department of workforce 9 development, in consultation with an eligible institution, that 10 leads to a credential aligned with a high-demand job designated 11 by the workforce development board or a community college, 12 may receive a future ready Iowa skilled workforce last-dollar 13 scholarship. The bill provides that “eligible program” shall 14 also include a program of study or an academic major jointly 15 approved by the college student aid commission and IWD that 16 leads to a credential aligned with at least 1 of 10 priority 17 in-demand fields designated by rule adopted by the workforce 18 development board. 19 The bill establishes that, among other additional 20 requirements, an “eligible student” may only receive a future 21 ready Iowa skilled workforce last-dollar scholarship if the 22 student has an expected family contribution of less than or 23 equal to $20,000, as determined by the free application for 24 federal student aid. 25 Current law authorizes the college student aid commission to 26 adopt rules, in collaboration with the department of workforce 27 development, for administration of the future ready Iowa 28 skilled workforce last-dollar scholarship program. The bill 29 establishes that these rules are required to authorize the 30 commission to determine the annual amount of a future ready 31 Iowa skilled workforce last-dollar scholarship based on the 32 type of eligible program in which the eligible student is 33 participating. 34 The bill requires the college student aid commission to 35 -14- LSB 5175SZ (2) 90 jda/jh 14/ 15
