Section
1.
Section
12.51,
subsection
2,
Code
2024,
is
1
amended
to
read
as
follows:

2.
a.
Moneys
in
the
fund
shall
not
be
transferred,
used,
3
obligated,
appropriated,
or
otherwise
encumbered
except
as
4
provided
in
this
section
.
5
b.
Annually,
seventy-five
percent
of
the
moneys
in
the
fund
6
shall
be
appropriated
to
the
department
of
health
and
human
7
services
and
twenty-five
percent
of
the
moneys
in
the
fund
8
shall
be
appropriated
to
the
office
of
the
attorney
general.
9
The
moneys
appropriated
shall
be
disbursed
by
the
department
10
of
health
and
human
services
and
the
office
of
the
attorney
11
general
in
accordance
with
the
requirements
of
any
master
12
settlement
agreement
and
this
section.
The
moneys
disbursed
by
13
the
department
of
health
and
human
services
or
the
office
of
14
the
attorney
general
shall
be
accompanied
by
a
statement
on
any
15
printed
or
marketing
materials
that
the
funding
is
a
one-time
16
allocation
from
the
opioid
settlement
fund.

c.
Moneys
in
the
fund
shall
only
be
used
pursuant
to
18
appropriations
from
the
fund
by
the
general
assembly
for
19
purposes
of
abating
the
opioid
crisis
in
this
state,
which
20
may
include
but
are
not
limited
to
the
purposes
specified
in
21
section
135.190A
for
moneys
in
the
opioid
antagonist
medication
22
fund.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
24
importance,
takes
effect
upon
enactment.

EXPLANATION
26
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
27
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
appropriation
of
moneys
in
the
29
opioid
settlement
fund
created
in
Code
section
12.51.
30
The
bill
provides
that
annually,
75
percent
of
the
moneys
in
31
the
fund
shall
be
appropriated
to
the
department
of
health
and
32
human
services
(HHS)
and
25
percent
of
the
moneys
in
the
fund
33
shall
be
appropriated
to
the
office
of
the
attorney
general
34
(AG).
Moneys
appropriated
to
HHS
or
the
AG
shall
be
disbursed

accordance
with
the

of
any
