S.F. 2383 Section 1. Section 256C.3, subsection 3, paragraph f, Code 1 2024, is amended by striking the paragraph and inserting in 2 lieu thereof the following: 3 f. (1) The following minimum hours per week of instruction, 4 as chosen by the school district at the beginning of the school 5 year, delivered on the skills and knowledge included in the 6 student learning standards developed for the preschool program: 7 (a) For the school year beginning July 1, 2024, either of 8 the following: 9 (i) Ten hours per week of instruction for each student. 10 (ii) (A) Ten hours per week of instruction for students not 11 described in subparagraph part (B). 12 (B) For eligible students whose household income is less 13 than one hundred eighty-five percent of the federal poverty 14 level applicable to the family’s size, fifteen hours per week 15 of instruction. 16 (b) For school years beginning on or after July 1, 2025, 17 either of the following: 18 (i) Ten hours per week of instruction for each student. 19 (ii) (A) Ten hours per week of instruction for students not 20 described in subparagraph part (B). 21 (B) For eligible students whose household income is less 22 than one hundred eighty-five percent of the federal poverty 23 level applicable to the family’s size, twenty hours per week 24 of instruction. 25 (2) If a school district chooses to satisfy the minimum 26 hour requirements for a school year under subparagraph (1), 27 subparagraph division (a), subparagraph subdivision (ii), 28 families of eligible children whose household income is less 29 than one hundred eighty-five percent of the federal poverty 30 level applicable to the family’s size may choose between ten 31 hours of instruction per week or fifteen hours of instruction 32 per week. 33 (3) If a school district chooses to satisfy the minimum 34 hour requirements for a school year under subparagraph (1), 35 -1- LSB 5223SV (2) 90 dg/jh 1/ 4
S.F. 2383 subparagraph division (b), subparagraph subdivision (ii), 1 families of eligible children whose household income is less 2 than one hundred eighty-five percent of the federal poverty 3 level applicable to the family’s size may choose between ten 4 hours of instruction per week or twenty hours of instruction 5 per week. 6 Sec. 2. Section 256C.5, subsection 1, paragraph c, Code 7 2024, is amended by striking the paragraph and inserting in 8 lieu thereof the following: 9 c. “Preschool budget enrollment” means either of the 10 following figures as applicable to the school district based on 11 the numbers of eligible students approved to participate and 12 enrolled in the preschool programming provided by the school 13 district on October 1 of the base year, or the first Monday in 14 October if October 1 falls on a Saturday or Sunday: 15 (1) For a school district providing minimum required school 16 hours as set under section 256C.3, subsection 3, paragraph 17 “f” , subparagraph (1), subparagraph division (a), subparagraph 18 subdivision (i), or section 256C.3, subsection 3, paragraph 19 “f” ,subparagraph (1), subparagraph division (b), subparagraph 20 subdivision (i), fifty percent of the actual enrollment of 21 eligible students. 22 (2) For a school district providing minimum required school 23 hours as set under section 256C.3, subsection 3, paragraph 24 “f” , subparagraph (1), subparagraph division (a), subparagraph 25 subdivision (ii), the sum of all of the following: 26 (a) Fifty percent of the actual enrollment of eligible 27 students not described in subparagraph division (b). 28 (b) Seventy-five percent of the actual enrollment of 29 eligible students who receive a minimum of fifteen hours of 30 instruction per week and whose household income is less than 31 one hundred eighty-five percent of the federal poverty level 32 applicable to the family’s size. 33 (3) For a school district providing minimum required school 34 hours as set under section 256C.3, subsection 3, paragraph 35 -2- LSB 5223SV (2) 90 dg/jh 2/ 4
S.F. 2383 “f” , subparagraph (1), subparagraph division (b), subparagraph 1 subdivision (ii), the sum of all of the following: 2 (a) Fifty percent of the actual enrollment of eligible 3 students not described in subparagraph division (b). 4 (b) The actual enrollment of eligible students who receive 5 a minimum of twenty hours of instruction per week and whose 6 household income is less than one hundred eighty-five percent 7 of the federal poverty level applicable to the family’s size. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to statewide voluntary preschool program 12 (SVPP) students whose household income is below a certain 13 amount, minimum hours required to be offered, and funding 14 calculations. 15 The bill allows each school district to choose at the 16 beginning of each school year between the currently required 17 minimum 10 hours of instruction per week for an enrolled child, 18 or a heightened required amount of hours for enrolled children 19 whose household family income is below 185 percent of the 20 federal poverty level (FPL) and a required 10 hours per week 21 of instruction for all other children. For FY 2024-2025, the 22 heightened requirement is a minimum of 15 hours per week of 23 instruction, and for FY 2025-2026, and each succeeding school 24 year, the heightened requirement is a minimum of 20 hours per 25 week of instruction. 26 The bill requires school districts to allow families of 27 children whose household income is below 185 percent of the 28 FPL applicable to the family’s size to choose between 10 hours 29 of instruction per week or the minimum hours of instruction 30 established for children of families with income below 185 31 percent of the FPL applicable to the family’s size for the 32 child. 33 A school district with an approved SVPP is funded in part by 34 preschool foundation aid payments. S.F. 2383 aid is calculated by multiplying the regular program state cost 1 per pupil by the school district’s preschool budget enrollment. 2 Currently, the preschool budget enrollment for a given year 3 is calculated by multiplying the number of eligible students 4 enrolled in the preschool program by 50 percent. 5 The bill changes the calculation for preschool budget 6 enrollment for school districts that choose to follow the 7 heightened hours of instruction requirement for children whose 8 household income is below 185 percent of the FPL to the sum 9 of the following number of eligible students: (1) for the 10 school year beginning July 1, 2024, 75 percent of eligible 11 students who receive 15 hours per week of instruction and whose 12 household income is less than 185 percent of the FPL plus 50 13 percent of all other eligible students; and (2) for school 14 years beginning on or after July 1, 2025, the actual number of 15 eligible students who receive 20 hours per week of instruction 16 and whose household income is less than 185 percent of the FPL 17 plus 50 percent of all other eligible students.
