S.F. 237 Section 1. Section 321E.24, Code 2023, is amended to read 1 as follows: 2 321E.24 Warning and lighting devices on oversize vehicles and 3 loads. 4 The department shall adopt rules pursuant to chapter 17A 5 regarding oversize load signs, warning flags, vehicle length 6 warning lights, and projecting-load lights. A vehicle or 7 combination of vehicles with a gross weight or combined gross 8 weight exceeding eighty thousand pounds shall not be required 9 to display warning lights based on the vehicle’s weight, but 10 may otherwise be required to display warning lights based on 11 length, a projecting load, or other factors, as provided by 12 law. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 Pursuant to Code section 321E.24, the department of 17 transportation (DOT) adopted administrative rules regarding 18 oversize load signs, warning flags, warning lights, and 19 projecting-load lights (761 IAC 511.18(3)). The DOT’s rules 20 require vehicles longer than 85 feet but not longer than 120 21 feet, vehicles with a front projection over 25 feet, vehicles 22 with a rear projection over 10 feet, and vehicles weighing 23 over 80,000 pounds to display a flashing or strobe amber light 24 that is visible for at least 500 feet and provides 360-degree 25 warning, which light must be mounted on the towing unit and be 26 visible from the front and rear. 27 This bill provides that vehicles exceeding 80,000 pounds are 28 not required to display warning lights based on the vehicle’s 29 weight. 30 -1- LSB 1952XS (2) 90 th/ns 1/ 1
