S.F. 2329 Section 1. Section 216.19, Code 2024, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 9. Any complaint filed with a local agency 3 or commission where a party is a political subdivision shall be 4 referred to the Iowa civil rights commission for processing. 5 NEW SUBSECTION . 10. a. A local agency or commission 6 complaint, upon request by any party, shall be transferred 7 to the Iowa civil rights commission for processing if the 8 complaint alleges a violation of this chapter and has not 9 been resolved within twelve months of the filing date of the 10 complaint. 11 b. The local agency or commission shall within three 12 hundred days of the filing date of the complaint do all of the 13 following: 14 (1) Send notice to all parties of a party’s right to direct 15 transfer of the complaint to the Iowa civil rights commission 16 from the local agency or commission after twelve months if the 17 complaint alleges a violation of this chapter. The notice 18 shall be sent to all parties by verified mail, or electronic 19 notice if the party is enrolled in electronic notification. 20 (2) Cross file a complaint with the Iowa civil rights 21 commission if the local agency or commission complaint arises 22 from an alleged violation of a state law, rule, or regulation 23 under the jurisdiction of the Iowa civil rights commission. 24 This subparagraph shall not be construed to prohibit a local 25 agency or commission from cross filing a complaint with any 26 other federal or state agency, commission, or entity, if the 27 local agency or commission complaint arises from an alleged 28 violation of a state or federal law, rule, or regulation of a 29 state or federal agency, commission, or entity. 30 NEW SUBSECTION . 11. The term of a commissioner appointed to 31 a local agency or commission shall be for two years. 32 EXPLANATION 33 The inclusion of this explanation does not constitute agreement with 34 the explanation’s substance by the members of the general assembly. 35 -1- LSB 5171SV (3) 90 cm/jh 1/ 2
S.F. 2329 This bill relates to local civil rights commissions or 1 agencies. 2 The bill provides that any complaint that is filed with 3 a local commission or agency where a party is a political 4 subdivision shall be referred to the Iowa civil rights 5 commission for processing. The bill provides that a local 6 agency or commission complaint, upon request by any party, 7 shall be transferred to the Iowa civil rights commission for 8 processing if the complaint alleges a violation of the Iowa 9 civil rights Act of 1965 and has not been resolved within 12 10 months of the filing date of the complaint. The bill requires 11 the local agency or commission to within 300 days of the filing 12 date of the complaint: (1) send notice to all parties of the 13 party’s right to direct transfer to the Iowa civil rights 14 commission after 12 months by verified mail, or electronic 15 notice, and (2) cross file a complaint with the Iowa civil 16 rights commission if the local agency or commission complaint 17 arises from an alleged violation of a state law, rule, or 18 regulation under the jurisdiction of the Iowa civil rights 19 commission. The bill does not prohibit a local agency or 20 commission from cross filing a complaint with any other federal 21 or state agency, commission, or entity, if the local agency 22 or commission complaint arises from an alleged violation of a 23 state or federal law, rule, or regulation of a state or federal 24 agency, commission, or entity. 25 The bill provides that the term of a commissioner of a local 26 agency or commission is two years. 27 -2- LSB 5171SV (3) 90 cm/jh 2/ 2
