S.F. 2303 Section 1. Section 249A.30A, Code 2024, is amended to read 1 as follows: 2 249A.30A Medical assistance —— personal needs allowance —— 3 appropriation . 4 The personal needs allowance under the medical assistance 5 program, which may be retained by a person who is a resident of 6 a nursing facility, an intermediate care facility for persons 7 with an intellectual disability, or an intermediate care 8 facility for persons with mental illness, as defined in section 9 135C.1 , or a person who is a resident of a psychiatric medical 10 institution for children as defined in section 135H.1 , shall 11 be fifty eighty-five dollars per month. A resident who has 12 income of less than fifty eighty-five dollars per month shall 13 receive a supplement from the state in the amount necessary to 14 receive a personal needs allowance of fifty eighty-five dollars 15 per month , if funding is specifically appropriated for this 16 purpose . The general assembly shall appropriate a sufficient 17 amount annually from the general fund of the state to the 18 department to provide the supplementation specified under this 19 section. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill provides for an increase, from $50 to $85, in the 24 personal needs allowance under Medicaid retained by a person 25 who is a resident of a nursing facility, an intermediate care 26 facility for persons with an intellectual disability, or an 27 intermediate care facility for persons with mental illness, or 28 a person who is a resident of a psychiatric medical institution 29 for children. A resident who has income of less than $85 per 30 month shall receive a supplement from the state as necessary to 31 receive a personal needs allowance of $85. The bill provides 32 for an annual appropriation from the general fund of the state 33 to the department of health and human services an amount 34 sufficient to provide the supplementation specified in the 35 -1- LSB 5727XS (5) 90 pf/ko 1/ 2
