S.F. 2285 Section 1. Section 135.16A, subsection 2, paragraph b, Code 1 2024, is amended to read as follows: 2 b. If necessary to implement, administer, and enforce this 3 section , the department, in cooperation with the department 4 of agriculture and land stewardship, shall submit a request 5 to the United States department of agriculture for a waiver 6 or other exception from regulations as deemed feasible by the 7 department. The department shall regularly report the status 8 of such request to the legislative services agency. 9 Sec. 2. Section 135.181, subsection 4, Code 2024, is amended 10 by striking the subsection. 11 Sec. 3. Section 139A.26, subsection 5, Code 2024, is amended 12 to read as follows: 13 5. The department shall adopt rules for administration of 14 this section . The department shall review the requirements 15 of this section at least every five years, and shall submit 16 its recommendations for modification to, or continuation of, 17 this section based upon new information about the disease 18 or vaccination against the disease in a report that shall 19 be submitted to the general assembly no later than January 20 15, 2010, with subsequent reports developed and submitted by 21 January 15 at least every fifth year thereafter. 22 Sec. 4. Section 217.21, Code 2024, is amended by striking 23 the section and inserting in lieu thereof the following: 24 217.21 Annual report. 25 The department shall annually report no later than October 1 26 on the period ending with the June 30 preceding, pursuant to 27 section 217.22, itemized departmental expenditures concerning 28 each program under the department’s administration and 29 adequate and complete statistical reports for the state as 30 a whole concerning all payments made under the department’s 31 administration. 32 Sec. 5. NEW SECTION . 217.22 Publicly available reportable 33 information. 34 The department shall make reportable information and data 35 -1- LSB 5352SV (5) 90 pf/ko 1/ 7

S.F. 2285 publicly available through modernized, interactive displays 1 found on the department’s internet site. The information and 2 data within the interactive display shall be downloadable and 3 contain the date and time of the download. 4 Sec. 6. Section 225D.2, subsection 5, paragraph d, Code 5 2024, is amended by striking the paragraph and inserting in 6 lieu thereof the following: 7 d. The department shall report on the program and fund 8 pursuant to section 217.21. 9 Sec. 7. Section 231E.4, subsection 3, paragraph h, Code 10 2024, is amended to read as follows: 11 h. Maintain statistical data on the local offices including 12 various methods of funding, the types of services provided, and 13 the demographics of the wards and clients, and report pursuant 14 to the general assembly on or before November 1, annually, 15 regarding the local offices and recommend any appropriate 16 legislative action section 217.22 . 17 Sec. 8. Section 235A.23, Code 2024, is amended to read as 18 follows: 19 235A.23 Reports. 20 1. The department may compile statistics, conduct research, 21 and issue reports on child abuse, provided identifying details 22 of the subject of child abuse reports are deleted from any 23 report issued pursuant to section 217.22 . 24 2. The department shall issue an annual report on its 25 administrative operation, including information as to the 26 number of requests for child abuse data, the proportion of 27 requests attributable to each type of authorized access, the 28 frequency and nature of irregularities, and other pertinent 29 matters. 30 Sec. 9. Section 235B.13, Code 2024, is amended to read as 31 follows: 32 235B.13 Registry reports. 33 1. The registry may compile statistics, conduct research, 34 and issue reports on dependent adult abuse, provided 35 -2- LSB 5352SV (5) 90 pf/ko 2/ 7

S.F. 2285 identifying details of the subjects of dependent adult abuse 1 reports are deleted from any report issued , pursuant to section 2 217.22 . 3 2. The registry shall issue an annual report on its 4 administrative operation, including information as to the 5 number of requests for dependent adult abuse data, the 6 proportion of requests attributable to each type of authorized 7 access, the frequency and nature of irregularities, and other 8 pertinent matters. 9 Sec. 10. Section 249A.4, subsection 1, Code 2024, is amended 10 to read as follows: 11 1. Determine the greatest amount, duration, and scope 12 of assistance which may be provided, and the broadest range 13 of eligible individuals to whom assistance may effectively 14 be provided, under this chapter within the limitations of 15 available funds. In so doing, the director shall at least 16 every six months evaluate the scope of the program currently 17 being provided under this chapter , project the probable cost 18 of continuing a like program, and compare the probable cost 19 with the remaining balance of the state appropriation made for 20 payment of assistance under this chapter during the current 21 appropriation period. After each evaluation of the scope of 22 the program, the director shall report to the general assembly 23 through the legislative council or in another manner as the 24 general assembly may by resolution direct. 25 Sec. 11. Section 249A.24, subsection 4, Code 2024, is 26 amended by striking the subsection. 27 Sec. 12. REPEAL. Section 142C.17, Code 2024, is repealed. 28 Sec. 13. EFFECTIVE DATE. This Act, being deemed of 29 immediate importance, takes effect upon enactment. 30 Sec. 14. RETROACTIVE APPLICABILITY. S.F. 2285 This bill makes changes to the reporting requirements for 1 the department of health and human services (HHS). 2 The bill amends Code section 135.16A(2)(b) relating to 3 vendors participating in federal nutrition program egg sales, 4 by eliminating the requirement that HHS regularly report the 5 status of any request to the United States department of 6 agriculture for a waiver or other exception from regulations as 7 deemed feasible by HHS to the legislative services agency. 8 The bill amends Code section 135.181(4) by striking the 9 subsection which requires HHS to submit an annual report to 10 the governor and the general assembly no later than January 1, 11 based on the immediately preceding fiscal year, relating to the 12 board-certified behavior analyst and board-certified assistant 13 behavior analyst grants program and fund, including the number 14 of applications received, the number of applications approved 15 and the total amount of funding awarded in grants, the cost of 16 administering the program, and recommendations for any changes 17 to the program. 18 The bill amends Code section 139A.26(5) relating to 19 meningococcal disease vaccination information for postsecondary 20 students. The bill retains the portion of the subsection 21 requiring HHS to adopt administrative rules to administer the 22 Code section, but eliminates the requirement that HHS review 23 the requirements of the Code section at least every five years 24 and submit recommendations for modification or continuation 25 of the section based on new information about the disease or 26 vaccination against the disease in a report to the general 27 assembly no later than January 15, 2010, with subsequent 28 reports developed and submitted by January 15 at least every 29 fifth year thereafter. 30 The bill strikes Code section 217.21 (annual report), 31 that requires HHS to annually report to the governor and the 32 general assembly specified information for the annual period 33 ending with June 30 preceding, and replaces the section with a 34 requirement that HHS annually report no later than October 1 35 -4- LSB 5352SV (5) 90 pf/ko 4/ 7

S.F. 2285 on the period ending with June 30 preceding, pursuant to new 1 Code section 217.22 (publicly available reportable information) 2 itemized departmental expenditures concerning each program 3 under the department’s administration and adequate and complete 4 statistical reports for the state as a whole concerning all 5 payments made under the department’s administration. 6 The bill includes new Code section 217.22, that requires 7 HHS to make reportable information and data publicly available 8 through modernized, interactive displays found on the HHS 9 internet site. The information and data within the interactive 10 display shall be downloadable and contain the date and time of 11 the download. 12 The bill amends Code section 225D.2(5)(d), relating to the 13 autism support program and fund, by striking the paragraph 14 which requires HHS to submit an annual report with specified 15 information to the governor and the general assembly no later 16 than January 1, based on the immediately preceding fiscal year, 17 and instead requires HHS to report on the program and fund 18 pursuant to Code section 217.21 as enacted in the bill, and 19 requires annual reporting no later than October 1. 20 The bill amends Code section 231E.4(3)(h), relating to the 21 state office of public guardian, by amending the paragraph to 22 still require that the state office maintain statistical data 23 on the local offices including various methods of funding, the 24 types of services provided, and the demographics of the wards 25 and clients, but eliminating the requirement that this data be 26 reported to the general assembly annually regarding the local 27 offices and recommending any appropriate legislative action. 28 Instead, the bill requires that the report be made pursuant to 29 Code section 217.22 as enacted in the bill and requires that 30 reportable information and data be publicly available on the 31 HHS internet site. 32 The bill amends Code section 235A.23(2) by striking 33 the subsection which requires HHS to issue an annual 34 report relating to the child abuse registry including its 35 -5- LSB 5352SV (5) 90 pf/ko 5/ 7

S.F. 2285 administrative operation, information as to the number of 1 requests for child abuse data, the proportion of requests 2 attributable to each type of authorized access, the frequency 3 and nature of irregularities, and other pertinent matters. 4 Instead, the bill provides that HHS may compile statistics, 5 conduct research, and issue reports on child abuse, provided 6 identifying details of the subject of the reports are deleted 7 from any report issued pursuant to Code section 217.22 as 8 enacted in the bill. 9 The bill amends Code section 235B.13(2) by striking the 10 subsection which requires the dependent adult abuse registry 11 to issue an annual report on its administrative operation, 12 including information on the number of requests for dependent 13 adult abuse data, the proportion of requests attributable to 14 each type of authorized access, the frequency and nature of 15 irregularities, and other pertinent matters. Instead, the bill 16 provides that the registry may compile statistics, conduct 17 research, and issue reports provided that the identifying 18 details of the subjects of the reports are deleted from any 19 reports issued pursuant to Code section 217.22 as enacted in 20 the bill. 21 The bill amends Code section 249A.4(1), relating to the 22 duties of the director of HHS, to eliminate the requirement 23 that in determining the greatest amount, duration, and scope 24 of assistance and the broadest range of eligible individuals 25 to whom assistance may be provided under the Medicaid chapter 26 within available funds, the director be required to evaluate 27 the scope of the current program at least every six months, 28 project the probable cost of continuing a like program, compare 29 the probable cost with the remaining balance of the state 30 appropriation for the current appropriation period, and report 31 to the general assembly through the legislative council or 32 in another manner as the general assembly may by resolution 33 direct. 34 The bill amends Code section 249A.24(4), by striking the 35 -6- LSB 5352SV (5) 90 pf/ko 6/ 7

S.F. 2285 subsection that requires the Iowa medical assistance drug 1 utilization review commission to submit an annual review of 2 the drugs on the HHS’s prior authorization list to HHS and 3 the members of the general assembly’s joint appropriations 4 subcommittee on health and human services. 5 The bill repeals Code section 142C.17 (annual donation 6 and compliance report). The Code section requires HHS, in 7 conjunction with any statewide organ procurement organization 8 in Iowa, to prepare and submit a report to the general assembly 9 on or before January 1 each year regarding organ donation rates 10 and voluntary compliance efforts with hospital organ and tissue 11 donation protocols by physicians, hospitals, and other health 12 systems organizations, and specified the information to be 13 included in the report. 14 The bill takes effect upon enactment and applies 15 retroactively to reports due on or after January 1, 2024. 16 -7- LSB 5352SV (5) 90 pf/ko 7/ 7
