S.F. 220 Section 1. NEW SECTION . 327D.6 Lighted lamps required. 1 A railroad train, as defined in section 321.1, shall display 2 lighted lamps when operated at any time from sunset to sunrise. 3 However, a lighted lamp shall not be displayed inside the cabin 4 if such lamp would harm the vision of the engineer, conductor, 5 brake operator, or any other member of the crew of a railroad 6 train while operating the railroad train. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 Code chapter 327D provides for the regulation of carriers. 11 This bill requires a railroad train to display lighted lamps 12 when operated at any time from sunset to sunrise. However, 13 displaying a lighted lamp is prohibited inside the cabin if 14 such lamp would harm the vision of the engineer, conductor, 15 brake operator, or any other member of the crew of a railroad 16 train while operating the railroad train. Under Code section 17 321.1, “railroad train” means an engine or locomotive with or 18 without cars coupled thereto, operated upon rails. 19 Pursuant to Code section 327D.17, a violation of the bill is 20 a simple misdemeanor punishable as a schedule “four” penalty 21 under Code section 327C.5, a fine of not less than $500 nor 22 more than $5,000 per violation. In addition, if a violation 23 results in injury to a person, the person may demand in 24 writing, as provided in accordance with Code section 327D.16, 25 that such a violation result in treble damages, attorney fees, 26 and costs. 27 -1- LSB 1904XS (2) 90 th/ns 1/ 1
