S.F. 2131 Section 1. Section 68B.5A, subsection 4, Code 2024, is 1 amended to read as follows: 2 4. A person who is subject to the requirements of subsection 3 1 and a person who served as an executive or administrative 4 head of a licensing board, as defined in section 272C.1, shall 5 not within two years after the termination of service or 6 employment become a lobbyist. 7 Sec. 2. NEW SECTION . 272C.7A Executive or administrative 8 head of licensing board —— disqualified —— penalty. 9 1. A person who was a lobbyist, as defined in section 68B.2, 10 shall not serve as the executive or administrative head of 11 a licensing board within two years after the person stopped 12 lobbying. 13 2. A person who knowingly and intentionally violates this 14 section commits a serious misdemeanor. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 Under current law, a person who serves as a statewide elected 19 official, the executive or administrative head of an agency of 20 state government, the deputy executive or administrative head 21 of an agency of state government, and a member of the general 22 assembly are prohibited from becoming a lobbyist for two years 23 following the termination of service or employment. 24 This bill also prohibits an executive or administrative 25 head of a licensing board, as defined in Code section 272C.1, 26 from acting as a lobbyist for two years after the termination 27 of the person’s service or employment. Additionally, the 28 bill prohibits a person who was a lobbyist from serving as an 29 executive or administrative head of a licensing board for two 30 years after the person stopped lobbying. Code section 272C.1 31 includes 32 specifically identified licensing boards. 32 The bill does not prohibit an executive or administrative 33 head of a licensing board from lobbying as the board’s 34 executive director. 35 -1- LSB 5728XS (2) 90 th/jh 1/ 2
S.F. 2131 By operation of law, a person who knowingly and 1 intentionally acts as a lobbyist when prohibited from being 2 a lobbyist is guilty of a serious misdemeanor and may be 3 reprimanded, suspended, or dismissed from the person’s position 4 or otherwise sanctioned. Under the bill, a person who was 5 a lobbyist and then serves as an executive or administrative 6 head of a licensing board when prohibited commits a serious 7 misdemeanor. A serious misdemeanor is punishable by 8 confinement for no more than one year and a fine of at least 9 $430 but not more than $2,560. 10 -2- LSB 5728XS (2) 90 th/jh 2/ 2
