S.F. 2119 Section 1. Section 299.1B, Code 2024, is amended to read as 1 follows: 2 299.1B Failure to attend —— driver’s license. 3 1. A person who is of compulsory attendance age who does 4 not meet the requirements for an exception under section 5 299.2 , who does not attend a public school or an accredited 6 nonpublic school, who is not receiving competent private 7 instruction or independent private instruction in accordance 8 with the provisions of chapter 299A , and who does not attend 9 an alternative school or adult education classes, shall not 10 receive an intermediate or full driver’s license until age 11 eighteen. 12 2. A person of compulsory attendance age who is deemed 13 to be a truant as described in section 299.8 for ten percent 14 or more of the days in a semester or term of a school year 15 or instruction year shall not receive an intermediate or 16 full driver’s license until age eighteen. If the person has 17 already received an intermediate or full driver’s license, the 18 department of transportation shall suspend the license until 19 the person is age eighteen. The board of directors of a public 20 school district, the authorities in charge of an accredited 21 nonpublic school, or any other person providing instruction 22 to a person as described in subsection 1 who is truant to the 23 extent described in this subsection shall promptly report 24 the person to the department of transportation in a manner 25 prescribed by the department. 26 Sec. 2. Section 321.213B, Code 2024, is amended to read as 27 follows: 28 321.213B Suspension for failure to attend. 29 The department shall establish procedures by rule for 30 suspending the license of a juvenile who has been issued a 31 driver’s license and is not in compliance with the requirements 32 of section 299.1B , declining to issue a license to such a 33 juvenile, or , if applicable, issuing the juvenile a restricted 34 license under section 321.178 . 35 -1- LSB 6168XS (2) 90 je/jh 1/ 2
S.F. 2119 EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This bill provides that a person of compulsory attendance 4 age who is deemed to be a truant for 10 percent or more of the 5 days in a semester or term of a school year or instruction 6 year shall not receive an intermediate or full driver’s 7 license until age 18. If the person has already received an 8 intermediate or full driver’s license, the bill requires the 9 department of transportation to suspend the license until 10 the person is age 18. The school board, the authorities in 11 charge of an accredited nonpublic school, or any other person 12 providing instruction to a person who is truant to the extent 13 described in the bill shall promptly report the person to the 14 department of transportation. 15 -2- LSB 6168XS (2) 90 je/jh 2/ 2
