The declaration of a common interest community, the 3 bylaws of a unit owners association or an executive board, and 4 the rules of a unit owners association or a common interest 5 community shall not prohibit a unit owner from displaying or 6 flying the American flag, in a size no greater than three feet 7 by five feet, attached on the exterior of the unit owner’s 8 unit. 9 2. The declaration of a common interest community, the 10 bylaws of a unit owners association or an executive board, and 11 the rules of a unit owners association or a common interest 12 community shall not prohibit an owner from installing a 13 flagpole on any real property owned by the unit owner for 14 display of the American flag, in a size no greater than three 15 feet by five feet. 16 3. For purposes of this section, “American flag” means a 17 flag, as described in 4 U.S.C. ch. 1. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to the right of unit owners in common 22 interest communities to display the American flag. The bill 23 provides that a declaration of a common interest community, the 24 bylaws of a unit owners association or an executive board, and 25 the rules of a unit owners association or a common interest 26 community cannot prohibit a unit owner from displaying or 27 flying the American flag, in a size no greater than three feet 28 by five feet, attached on the exterior of the unit owner’s unit 29 or on a flagpole installed on any real property owned by the 30 unit owner.
