For purposes of this section, a “large capacity 3 ammunition feeding device” means a magazine, belt, drum, or 4 similar device that has a capacity of, or that can be readily 5 restored or converted to accept, more than fifteen rounds of 6 ammunition. 7 2. A person who sells or transfers any large capacity 8 ammunition feeding device commits an aggravated misdemeanor. 9 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 10 immediate importance, takes effect upon enactment. 11 Sec. 3. APPLICABILITY. This Act applies to any large 12 capacity ammunition feeding device sold or transferred on or 13 after the effective date of this Act. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill prohibits the sale or transfer of large capacity 18 ammunition feeding devices, provides a penalty, and includes 19 effective date and applicability provisions. 20 The bill provides that a person who sells or transfers any 21 large capacity ammunition feeding device commits an aggravated 22 misdemeanor, punishable by confinement for no more than two 23 years and a fine of at least $855 but not more than $8,540. 24 Under the bill, a “large capacity ammunition feeding device” 25 means a magazine, belt, drum, or similar device that has a 26 capacity of, or that can be readily restored or converted to 27 accept, more than 15 rounds of ammunition. 28 The bill takes effect upon enactment and applies to any large 29 capacity ammunition feeding device sold or transferred on or 30 after the effective date. 31 -1- LSB 5936XS (4) 90 as/js 1/ 1
