S.F. 2061 Section 1. Section 331.206, subsection 2, paragraph a, Code 1 2024, is amended to read as follows: 2 a. The plan used under subsection 1 shall be selected by the 3 board or by a special election as provided in section 331.207 . 4 A plan selected by the board shall remain in effect for at 5 least six years and shall only be changed by a special election 6 as provided in section 331.207 . However, a county with a 7 population of seventy-five thousand or more based on the most 8 recent federal decennial census shall use plan “three” for the 9 election of supervisors. 10 Sec. 2. Section 331.207, subsection 2, Code 2024, is amended 11 to read as follows: 12 2. The petition shall be filed with the county commissioner 13 by June 1 of an odd-numbered year , subject to subsection 14 6 . The special election shall be held on the first Tuesday 15 in August of the odd-numbered year. Notice of the special 16 election shall be published once each week for three successive 17 weeks in an official newspaper of the county, shall state the 18 representation plans to be submitted to the electors, and shall 19 state the date of the special election. The last in the series 20 of publications shall occur not less than four nor more than 21 twenty days before the election. 22 Sec. 3. Section 331.207, subsection 6, Code 2024, is amended 23 by striking the subsection. 24 Sec. 4. TRANSITION PROVISION. 25 1. Notwithstanding any provision of law to the contrary, a 26 county with a population of seventy-five thousand or more based 27 on the most recent federal decennial census that does not use 28 plan “three” for the election of supervisors, as described in 29 section 331.206, as of the effective date of this Act, shall 30 not be required to elect supervisors using plan “three” until 31 the election for supervisors in 2026, following the adoption 32 of a representation plan drawn pursuant to section 331.210A, 33 subsection 2, paragraph “f”, and the requirements of this 34 section. 35 -1- LSB 5314XS (2) 90 th/ns 1/ 2

A county required to adopt a representation plan as 1 provided in this section shall establish a temporary county 2 redistricting commission by the later of thirty days after the 3 effective date of this Act or May 15, 2024, and shall complete 4 a plan, in conformity with the requirements of sections 331.209 5 and 331.210A, no later than November 1, 2024. The plan shall 6 be submitted to the state commissioner of elections and shall 7 become effective January 1, 2025. 8 Sec. 5. EFFECTIVE DATE. This Act, being deemed of immediate 9 importance, takes effect upon enactment. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill requires a county with a population of 75,000 14 or more based on the most recent federal decennial census 15 to use plan “three” for the election of county supervisors. 16 Plan “three” requires individual members of the board of 17 supervisors for that county to be elected from single-member 18 equal-population districts. The bill provides that a county 19 with a population of 75,000 or more that does not use plan 20 “three” as of the bill’s effective date for the election of 21 supervisors is not required to elect supervisors under plan 22 “three” until the election for supervisors in 2026 following 23 adoption of a representation plan in conformity with the 24 provisions of law governing the adoption of a plan “three” 25 representation plan. 26 The bill takes effect upon enactment. 27 -2- LSB 5314XS (2) 90 th/ns 2/ 2
