S.F. 206 Section 1. MEDICAL ERROR TASK FORCE. 1 1. The department of health and human services shall 2 convene a task force to review medical error rates of licensed 3 physicians in this state and shall make recommendations to the 4 general assembly and the director of health and human services 5 including recommendations that address options for reducing 6 medical error rates, improvements in education and training 7 to minimize medical errors, and whether applicable penalties 8 for medical errors and physician licensure review measures are 9 sufficient. 10 2. a. The task force shall include all of the following 11 voting members: 12 (1) The director of health and human services, or the 13 director’s designee. 14 (2) The director of inspections and appeals, or the 15 director’s designee. 16 (3) The executive director of the board of medicine. 17 (4) The ombudsman. 18 (5) A representative of the Iowa medical society. 19 (6) A representative of the board of regents affiliated with 20 the university of Iowa hospitals and clinics. 21 (7) The commissioner of insurance, or the commissioner’s 22 designee. 23 (8) The attorney general, or the attorney general’s 24 designee. 25 b. The task force shall also include four members of the 26 general assembly serving as ex officio, nonvoting members, one 27 representative to be appointed by the speaker of the house of 28 representatives, one representative to be appointed by the 29 minority leader of the house of representatives, one senator to 30 be appointed by the president of the senate after consultation 31 with the majority leader of the senate, and one senator to be 32 appointed by the minority leader of the senate. 33 c. The director of health and human services, or the 34 director’s designee, may add members to the task force as 35 -1- LSB 2028XS (3) 90 pf/rh 1/ 2
S.F. 206 necessary to complete the work of the task force. 1 3. The department of health and human services shall provide 2 administrative support to the task force. The director of 3 health and human services, or the director’s designee, shall 4 serve as chairperson of the task force, and shall schedule 5 meetings of the task force as necessary to complete the work 6 of the task force. 7 4. The task force shall dissolve upon submission of the 8 report to the general assembly and the director of health and 9 human services, but no later than January 8, 2024. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill directs the department of health and human 14 services (HHS) to convene a task force to review medical 15 error rates of licensed physicians in this state and to make 16 recommendations to the general assembly and the director of HHS 17 including recommendations that address options for reducing 18 medical error rates, improvements in education and training 19 to minimize medical errors, and whether applicable penalties 20 for medical errors and physician licensure review measures are 21 sufficient. 22 The bill specifies the membership of the task force, 23 authorizes the director of HHS to add members as necessary to 24 complete the work of the task force, and directs HHS to provide 25 administrative support to the task force. The director of HHS 26 or the director’s designee shall serve as chairperson of the 27 task force and schedule meetings as necessary to complete the 28 work of the task force. 29 The task force shall dissolve upon submission of the report 30 to the general assembly and the director of HHS no later than 31 January 8, 2024. 32 -2- LSB 2028XS (3) 90 pf/rh 2/ 2
