Section
273.3,
Code
2024,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
19A.
Pursuant
to
rules
adopted
by
the
3
state
board
of
education,
be
authorized
to
charge
an
accredited
4
nonpublic
school
a
user
fee
for
any
materials
and
services
5
provided
to
the
accredited
nonpublic
school
or
its
students,
6
including
services
and
programs
as
provided
in
sections
7
273.1,
273.2,
this
section,
sections
273.4
through
273.8,
and
8
chapter
256B,
in
an
amount
not
to
exceed
the
actual
cost
of
the
9
materials
and
services
provided.

EXPLANATION
11
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
12
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Area
education
agencies
(AEAs)
were
created
in
order
14
to
provide
effective,
efficient,
and
economical
means
of
15
identifying
and
serving
children
who
require
special
education
16
by
providing
media
services
and
other
programs
to
K-12
pupils.
17
Services
and
materials
required
of
AEAs
by
statute
or
rule
are
18
funded
by
payments
from
school
districts
through
the
state
19
school
foundation
aid
the
school
district
receives
for
its
20
children
requiring
special
education.
AEAs
are
allowed
to
21
charge
a
fee
for
services
and
materials
a
public
or
nonpublic
22
school
requests
the
AEA
to
provide,
but
which
AEAs
are
not
23
required
to
provide
by
statute
or
rule.
24
This
bill
allows
AEAs
to
charge
an
accredited
nonpublic
25
school
a
user
fee
for
materials
and
services
provided
to
the
26
accredited
nonpublic
school
or
its
students
in
an
amount
not
to
27
exceed
the
actual
cost
of
the
materials
and
services
provided
28
for
all
services
that
the
AEA
provides.
