1.
Section
156.1,
Code
2023,
is
amended
by
adding
1
the
following
new
subsections:

NEW
SUBSECTION
.
8.
“Removal”
means
the
act
of
taking
3
human
remains
from
the
place
of
death
or
place
where
the
human
4
remains
are
being
held
to
a
funeral
establishment
or
other
5
designated
place.

NEW
SUBSECTION
.
9.
“Removal
specialist”
means
a
person
7
registered
with
the
board
to
perform
removals.

specialists.

The
board
shall
adopt
rules
pursuant
to
chapter
17A
to
allow
10
a
funeral
director,
without
first
assuming
custody
of
human
11
remains,
to
delegate
to
a
removal
specialist
the
ability
to
12
perform
a
removal
regardless
of
whether
the
funeral
director
13
is
present.
The
board
shall
consider
the
prerequisites
for
14
registration,
including
any
required
training
that
the
removal
15
specialist
shall
complete
prior
to
performing
a
removal.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
removal
of
human
remains
by
a
20
person
other
than
a
funeral
director.
The
bill
defines
21
“removal”
as
the
act
of
taking
human
remains
from
the
place
22
of
death
or
place
where
the
human
remains
are
being
held
to
23
a
funeral
establishment
or
other
designated
place.
The
bill
24
requires
the
board
of
mortuary
science
to
adopt
rules
allowing
25
a
funeral
director,
without
first
taking
custody
of
human
26
remains,
to
delegate
to
a
removal
specialist
the
removal
of
27
human
remains,
regardless
of
whether
the
funeral
director
is
28
present.
The
board
is
required
to
consider
prerequisites
for
29
the
registration
of
a
person
as
a
removal
specialist,
including
30
any
required
training.
