S.F. 191 Section 1. Section 123.130, Code 2023, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. a. For purposes of this subsection, 3 “manufacturer” includes only those persons who hold a class “A” 4 beer permit and manufacture beer in Iowa. 5 b. A manufacturer may use the space and equipment of 6 another manufacturer for the purpose of manufacturing beer, 7 provided that such an alternating proprietorship arrangement 8 is approved by the alcohol and tobacco tax and trade bureau of 9 the United States department of the treasury. A separate class 10 “A” beer permit shall be issued to each manufacturer, and each 11 manufacturer shall be subject to the provisions of this chapter 12 and the rules of the division. Notwithstanding subsection 2, 13 not more than one class “C” retail alcohol license shall be 14 issued to a premises with alternating proprietorships. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill allows a manufacturer of beer in Iowa to use the 19 space and equipment of another manufacturer of beer in Iowa for 20 the purpose of manufacturing beer pursuant to an alternating 21 proprietorship arrangement that is approved by the alcohol and 22 tobacco tax and trade bureau of the United States department 23 of the treasury.
