S.F. 19 Section 1. NEW SECTION . 70A.21 Donated leave for immediate 1 family members. 2 1. For purposes of this section: 3 a. “Donated leave” means vacation and sick leave hours 4 donated to an eligible recipient. 5 b. “Eligible recipient” means an eligible state employee’s 6 spouse, parent, son, or daughter who is also an eligible state 7 employee. 8 c. “Eligible state employee” means a full-time or part-time 9 state employee who is eligible to accrue vacation. 10 2. Eligible state employees are allowed to donate leave 11 hours to an eligible recipient. Contributions shall be 12 designated as donated leave and shall be subject to the 13 requirements of this section. 14 3. An eligible state employee shall be allowed to donate 15 leave to an eligible recipient subject to the following 16 requirements: 17 a. Vacation and sick leave hours shall be donated in 18 whole-hour increments; however, vacation and sick leave 19 hours may be credited to the eligible recipient in other than 20 whole-hour increments. Donated vacation hours shall not 21 exceed the maximum allowable vacation hours for the eligible 22 recipient. 23 b. Donated leave hours will be credited in increments not to 24 exceed the eligible employee’s regularly scheduled work hours 25 on a pay-period-by-pay-period basis. 26 c. Approval of use of donated leave shall be for a period 27 not to exceed one year either on an intermittent or continuous 28 basis for each occurrence. 29 d. Donated leave shall be irrevocable after it is credited 30 to the eligible recipient. Donated leave hours not credited to 31 the eligible recipient will not be deducted from the donor’s 32 vacation or sick leave balance. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -1- LSB 1311XS (2) 90 je/rn 1/ 2
S.F. 19 the explanation’s substance by the members of the general assembly. 1 This bill allows a full-time or part-time state employee 2 who is eligible to accrue vacation to donate vacation and 3 sick leave hours to an eligible recipient, defined as that 4 employee’s spouse, parent, son, or daughter who is also a state 5 employee. 6 The bill allows vacation and sick leave hours to be donated 7 to an eligible recipient. The bill provides that donated 8 vacation hours shall not exceed the maximum allowable vacation 9 hours for the eligible recipient. The bill provides that 10 approval of use of donated leave shall be for a period not to 11 exceed one year and that donated vacation and sick leave shall 12 be irrevocable after it is credited to the eligible recipient. 13 -2- LSB 1311XS (2) 90 je/rn 2/ 2
