S.F. 134 Section 1. Section 137F.6, subsection 1, paragraph h, Code 1 2023, is amended to read as follows: 2 h. For a farmers market where time/temperature control for 3 safety food is sold or distributed, one annual license fee 4 of one hundred fifty dollars for each vendor on a countywide 5 statewide basis. 6 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 7 importance, takes effect upon enactment. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill provides for the statewide licensure of farmers 12 markets under the regulatory jurisdiction of the department 13 of inspections and appeals (DIA) or a political subdivision 14 that has entered into a contract with DIA (together termed a 15 “regulatory authority”) under Code chapter 137F. According 16 to that chapter and rules adopted by DIA, a farmers market is 17 subject to regulation as a food establishment if its vendor 18 sells unpackaged foods that must be temperature controlled such 19 as meat, poultry, dairy products, cooked or prepared foods, 20 or soft pies requiring refrigeration (see 481 IAC 31.5). A 21 regulated farmers market must operate pursuant to an annual 22 license. A license fee of $150 is imposed for the issuance of 23 the license, which is valid on a countywide basis (Code section 24 137F.6). The bill provides that the license is valid on a 25 statewide basis. 26 The bill takes effect upon enactment. 27 -1- LSB 1122SV (1) 90 da/ns 1/ 1
