H.F. _____ Section 1. Section 256.9, Code 2024, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 36. a. Develop, in coordination with the 3 department of health and human services and any other entity 4 the director deems appropriate, informational materials related 5 to type one diabetes. The informational materials shall 6 include all of the following: 7 (1) A description of type one diabetes. 8 (2) A description of the risk factors and warning signs 9 associated with type one diabetes. 10 (3) A recommendation related to the warning signs 11 associated with type one diabetes that should cause the parent 12 or guardian of a student displaying such warning signs to 13 immediately consult with the student’s primary care provider 14 to determine if an immediate screening for type one diabetes 15 is appropriate. 16 (4) A description of the screening process for type one 17 diabetes and the implications of test results. 18 (5) A recommendation that, following a student’s type one 19 diabetes diagnosis, the student’s parent or guardian should 20 consult with the student’s primary care provider to develop 21 an appropriate treatment plan, which may include consultation 22 with and examination by a specialty care provider, including a 23 qualified endocrinologist. 24 b. Distribute the informational materials developed under 25 paragraph “a” to all of the following: 26 (1) School districts. 27 (2) Charter schools established pursuant to chapter 256E or 28 256F. 29 (3) Innovation zone schools established pursuant to chapter 30 256F. 31 c. Publish the informational materials developed under 32 paragraph “a” on the department’s internet site. 33 Sec. 2. Section 256E.7, subsection 2, Code 2024, is amended 34 by adding the following new paragraph: 35 -1- LSB 6337YC (3) 90 jda/jh 1/ 3

Be subject to and comply with the 1 requirements of section 279.84 relating to the provision of 2 informational materials related to type one diabetes developed 3 by the director of the department of education in the same 4 manner as a school district. 5 Sec. 3. Section 256F.4, subsection 2, Code 2024, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . p. Be subject to and comply with the 8 requirements of section 279.84 relating to the provision of 9 informational materials related to type one diabetes developed 10 by the director of the department of education in the same 11 manner as a school district. 12 Sec. 4. NEW SECTION . 279.84 Type one diabetes informational 13 materials. 14 Each school district shall provide the parent or guardian of 15 each student who enrolls in the school district for the first 16 time in grades one through six with copies of the informational 17 materials related to type one diabetes developed by the 18 director of the department of education pursuant to section 19 256.9, subsection 36, or with a link to the department’s 20 internet site where such informational materials are published. 21 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In accordance 22 with section 25B.2, subsection 3, the state cost of requiring 23 compliance with any state mandate included in this Act shall be 24 paid by a school district or charter school from state school 25 foundation aid received by the school district under section 26 257.16 or by a charter school from moneys received by the 27 charter school under section 256E.8. This specification of the 28 payment of the state cost shall be deemed to meet all of the 29 state funding-related requirements of section 25B.2, subsection 30 3, and no additional state funding shall be necessary for the 31 full implementation of this Act by and enforcement of this Act 32 against all affected school districts and charter schools. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -2- LSB 6337YC (3) 90 jda/jh 2/ 3
H.F. _____ the explanation’s substance by the members of the general assembly. 1 This bill requires public schools to provide diabetes 2 information to students’ parents and guardians. 3 The bill requires the director of the department of 4 education to develop, in coordination with the department of 5 health and human services and any other entity the director 6 deems appropriate, informational materials related to type 7 one diabetes. The bill establishes what the informational 8 materials are required to include. The bill requires the 9 director to distribute the informational materials to school 10 districts, charter schools, and innovation zone schools. The 11 bill also requires the director to publish the informational 12 materials on the department’s internet site. 13 The bill requires school districts, charter schools, and 14 innovation zone schools to provide the parent or guardian of 15 each student who enrolls in the school for the first time 16 in grades one through six with copies of the informational 17 materials or with a link to the department of education’s 18 internet site where such informational materials are published. 19 The bill may include a state mandate as defined in Code 20 section 25B.3. The bill requires that the state cost of any 21 state mandate included in the bill be paid by a school district 22 from state school foundation aid received by the school 23 district under Code section 257.16 or by the charter school 24 from moneys received by the charter school under Code section 25 256E.8. The specification is deemed to constitute state 26 compliance with any state mandate funding-related requirements 27 of Code section 25B.2.
