S.F. _____ H.F. _____ Section 1. Section 88B.3, subsection 4, Code 2024, is 1 amended by striking the subsection and inserting in lieu 2 thereof the following: 3 4. The department shall conduct an on-site inspection upon 4 a complaint, referral, injury, accident, or media notification, 5 or in case of imminent danger. 6 Sec. 2. Section 137C.12, Code 2024, is amended to read as 7 follows: 8 137C.12 Inspection upon complaint. 9 Upon receipt of a verified complaint signed by a guest 10 of a hotel and stating facts indicating the place is in an 11 insanitary condition, the regulatory authority shall conduct 12 an inspection. The inspector may enter the hotel at any 13 reasonable hour to make the inspection. The management shall 14 afford free access to every part of the premises and render all 15 aid and assistance necessary to enable the inspector to make a 16 thorough and complete inspection. 17 Sec. 3. REPEAL. Section 137C.11, Code 2024, is repealed. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill strikes the requirement that the department 22 of inspections, appeals, and licensing (DIAL) conduct an 23 annual inspection of a business entity permitted to remove or 24 encapsulate asbestos, and instead requires DIAL to inspect such 25 entities upon complaints, referrals, injuries, accidents, or 26 media notifications, or in case of imminent danger. 27 The bill also repeals the requirement that DIAL or a local 28 board of health conduct biennial sanitation inspections of all 29 hotels in Iowa. The bill moves certain provisions associated 30 with inspections from the repealed provision to the provision 31 requiring DIAL to inspect a hotel upon receiving a complaint. 32 -1- LSB 5381DP (2) 90 sc/ns 1/ 1
