H.F. _____ Section 1. Section 13.2, subsection 1, Code 2024, is amended 1 by adding the following new paragraph: 2 NEW PARAGRAPH . q. Enforce the prohibitions on guaranteed 3 income programs as described in section 331.301, subsection 23, 4 and section 364.3, subsection 18. 5 Sec. 2. Section 331.301, Code 2024, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 23. a. Unless expressly authorized by 8 state law, a county shall not adopt, enforce, or maintain an 9 ordinance, order, or rule for the purpose of making payments to 10 individuals under a guaranteed income program. 11 b. The attorney general shall send a cease and desist order 12 to any county that adopts or enforces an ordinance, order, or 13 rule in violation of this subsection. 14 c. If the county fails to comply with the cease and desist 15 order, the attorney general shall bring an action in the name 16 of the state for injunctive relief against any county that 17 has adopted an ordinance, order, or rule in violation of this 18 subsection. 19 d. For purposes of this subsection, the term “guaranteed 20 income program” means a program under which individuals are 21 provided with regular periodic cash payments that are unearned 22 and that may be used for any purpose, but does not include a 23 program under which an individual is required to perform work 24 or attend training. 25 Sec. 3. Section 364.3, Code 2024, is amended by adding the 26 following new subsection: 27 NEW SUBSECTION . 18. a. Unless expressly authorized by 28 state law, a city shall not adopt, enforce, or maintain an 29 ordinance, order, or rule for the purpose of making payments to 30 individuals under a guaranteed income program. 31 b. The attorney general shall send a cease and desist order 32 to any city that adopts or enforces an ordinance, order, or 33 rule in violation of this subsection. 34 c. H.F. _____ order, the attorney general shall bring an action in the name 1 of the state for injunctive relief against any city that has 2 adopted an ordinance, order, or rule in violation of this 3 subsection. 4 d. For purposes of this subsection, the term “guaranteed 5 income program” means a program under which individuals are 6 provided with regular periodic cash payments that are unearned 7 and that may be used for any purpose, but does not include a 8 program under which an individual is required to perform work 9 or attend training. 10 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate 11 importance, takes effect upon enactment. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill prohibits a county or city from providing a 16 guaranteed income program unless expressly authorized by state 17 law. The attorney general shall enforce the prohibition on 18 the adoption, enforcement, or maintenance of a county or city 19 ordinance, order, or rule that provides a guaranteed income 20 program by sending the county or city a cease and desist order. 21 If the county or city fails to comply, the attorney general 22 shall bring an action for injunctive relief against the county 23 or city. 24 The bill takes effect upon enactment. 25 -2- LSB 5641YC (1) 90 lh/js 2/ 2
