Section 808.4, Code 2024, is amended to read as 1 follows: 2 808.4 Issuance. 3 Upon a finding of probable cause for grounds to issue a 4 search warrant, the magistrate shall issue a warrant, signed by 5 the magistrate with the magistrate’s name of office, directed 6 to any peace officer, commanding that peace officer forthwith 7 to search the named person, place, or thing within the state 8 for the property specified, and to bring a list of any property 9 seized before the magistrate. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill relates to the issuance of a search warrant. 14 The bill provides that after a peace officer has executed 15 a search warrant issued by a magistrate commanding the peace 16 officer to search the named person, place, or thing within the 17 state for the property specified, the peace officer shall bring 18 a list of any property seized before the magistrate. 19 Current law requires the peace officer to bring the seized 20 property before the magistrate. 21 -1- LSB 5495YC (1) 90 as/js 1/ 1
