There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. H.F. _____ apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- LSB 1008YC (6) 90 ec/rh 2/ 20
H.F. _____ agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A . 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated in 21 this lettered paragraph may be used for costs of administration 22 and implementation of the water quality initiative administered 23 by the soil conservation division. 24 b. EFFECTIVE DATE. This division of this Act, being 21 deemed of immediate importance, takes effect upon enactment. 22 DIVISION IV 23 MISCELLANEOUS PROVISIONS 24 Sec. 8. Section 8.57C, subsection 3, paragraph a, 25 subparagraph (3), Code 2023, is amended to read as follows: 26 (3) For the fiscal year beginning July 1, 2023 2024 , and for 27 each subsequent fiscal year thereafter, the sum of seventeen 28 million five hundred thousand dollars. 29 Sec. 9. Section 8.57C, subsection 3, Code 2023, is amended 30 by adding the following new paragraph: 31 NEW PARAGRAPH . k. There is appropriated from the rebuild 32 Iowa infrastructure fund for the fiscal year beginning July 1, 33 2023, and ending June 30, 2024, the sum of eighteen million 34 three hundred ninety thousand two hundred ninety dollars to the 35 -14- LSB 1008YC (6) 90 ec/rh 14/ 20
H.F. _____ technology reinvestment fund, notwithstanding section 8.57, 1 subsection 5, paragraph “c” . 2 DIVISION V 3 DESTINATION IOWA FUND 4 Sec. 10. NEW SECTION . 15.281 Destination Iowa fund. 5 1. For purposes of this section: 6 a. “Eligible applicant” means a city, county, or 7 not-for-profit organization. 8 b. “Rural community” means a community that has a population 9 of fewer than twenty thousand persons as determined by the most 10 recent population estimate produced by the United States bureau 11 of census or the most recent decennial census released by the 12 United States bureau of census. 13 c. “Vertical infrastructure” means land acquisition 14 and construction, major renovation and major repair of 15 buildings, all appurtenant structures, utilities, site 16 development, recreational trails, and water trails. “Vertical 17 infrastructure” does not include routine, recurring maintenance 18 or operational expenses or leasing of a building, appurtenant 19 structure, or utility without a lease-purchase agreement. 20 2. A destination Iowa fund is created in the state treasury 21 under the control of the authority. The fund shall consist of 22 all moneys appropriated to the fund. The board will oversee 23 and administer the destination Iowa fund. 24 3. Moneys in the destination Iowa fund are appropriated 25 to the authority for purposes of providing grants to eligible 26 applicants for any of the following types of projects: 27 a. Economically significant projects that increase tourism 28 opportunities. 29 b. Development and enhancement of outdoor recreational 30 opportunities. 31 c. Projects that contribute to quality of life in rural 32 communities. 33 4. Projects must meet all of the following criteria to be 34 eligible for a grant to an eligible applicant from the fund: 35 -15- LSB 1008YC (6) 90 ec/rh 15/ 20
H.F. _____ a. The project must be primarily vertical infrastructure. 1 b. The project must be available for year-round use by the 2 public. 3 c. An eligible applicant must intend to own the property 4 that is the subject of the project upon completion. 5 5. The board shall prioritize making awards to applicants 6 that have not been awarded money from the destination Iowa fund 7 or other programs intended to support community attraction 8 and tourism projects after July 1, 2018. The board shall 9 prioritize awarding grants to projects that include primarily 10 new construction over projects that primarily renovate or 11 replace existing facilities. The board shall not award a grant 12 in an amount exceeding fifty percent of the total cost of the 13 project. 14 6. At the beginning of each fiscal year, the authority 15 shall allocate fifty percent of the moneys available in the 16 destination Iowa fund to projects in rural communities. If 17 any portion of the moneys allocated under this subsection has 18 not been awarded by April 1 of the fiscal year for which the 19 allocation is made, the portion which has not been awarded may 20 be awarded to any eligible project in the state. If a county 21 is the applicant, a project will be deemed to be located in a 22 rural community if the geographic location of the project is in 23 or near a city that is a rural community. 24 7. Applications for grants from the destination Iowa fund 25 shall be submitted to the authority. For those applications 26 that meet the eligibility criteria described in subsection 27 4, the authority shall forward the applications and provide 28 a staff evaluation to the board. Work completed and costs 29 incurred prior to the date of board approval of a grant are 30 ineligible for reimbursement, except the acquisition of real 31 estate. 32 8. The board shall make final funding decisions on 33 each application and may approve, deny, defer, or modify 34 applications for grants under the program. H.F. _____ authority may negotiate with applicants regarding the details 1 of projects and the amount and terms of any award. In making 2 final funding decisions pursuant to this subsection, the board 3 and the authority are exempt from chapter 17A. 4 9. If an application is approved, the authority shall enter 5 into an agreement with the applicant to provide a grant awarded 6 from the fund. 7 10. Notwithstanding section 12C.7, subsection 2, 8 interest or earnings on moneys deposited in the destination 9 Iowa fund shall be credited to the destination Iowa fund. 10 Notwithstanding section 8.33, moneys credited to the 11 destination Iowa fund shall not revert at the close of a fiscal 12 year. The authority shall not use more than five percent of 13 the moneys in the fund at the beginning of each fiscal year for 14 purposes of administrative costs and program support. 15 DIVISION VI 16 ON-STREAM IMPOUNDMENT RESTORATION 17 Sec. 11. Section 456A.33C, subsections 2, 3, and 4, Code 18 2023, are amended by striking the subsections and inserting in 19 lieu thereof the following: 20 2. The department shall establish an on-stream impoundment 21 restoration program for purposes of funding projects for the 22 maintenance, restoration, and sustainability of eligible water 23 bodies and their related watersheds from moneys appropriated to 24 the department for this purpose. 25 3. a. The department shall fund projects for eligible water 26 bodies that are designed to achieve the following goals: 27 (1) Ensure a cost-effective, positive return on investment 28 for the citizens of Iowa. 29 (2) Ensure local community commitment to watershed 30 protection. 31 (3) Ensure significant improvement in water clarity, 32 safety, and quality. 33 (4) Provide for sustainable, healthy, and functioning 34 bodies of water. 35 -17- LSB 1008YC (6) 90 ec/rh 17/ 20
H.F. _____ (5) Contribute to the department’s fish and wildlife 1 conservation plans. 2 b. The process and criteria the department shall utilize 3 to fund projects under this section shall favor proposals 4 which include nonstate matching funds of at least one dollar 5 for every dollar of state funding, and funding for watershed 6 improvement practices and participation of corresponding 7 watershed management authority. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to and makes appropriations from 12 the rebuild Iowa infrastructure fund and the technology 13 reinvestment fund and provides for related matters. The bill 14 is organized by divisions. 15 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 16 division appropriates project funding for FY 2023-2024 from 17 the rebuild Iowa infrastructure fund for projects for the 18 departments of administrative services, agriculture and land 19 stewardship, the blind, corrections, education, health and 20 human services, natural resources, public defense, public 21 safety, and transportation, and for the economic development 22 authority, treasurer of state, ethics and campaign disclosure 23 board, Iowa communications network, board of regents, and the 24 judicial branch. 25 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 26 appropriates project funding for FY 2023-2024 from the 27 technology reinvestment fund for projects for the departments 28 of justice, corrections, education, health and human services, 29 homeland security and emergency management, management, and 30 revenue, and for the auditor of state, the board of parole, the 31 Iowa law enforcement academy, and the judicial branch. 32 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 33 division allows moneys appropriated from the rebuild Iowa 34 infrastructure fund to the board of regents for an industrial 35 -18- LSB 1008YC (6) 90 ec/rh 18/ 20
H.F. _____ technology center at the university of northern Iowa for FY 1 2022-2023 to also be expended for steam tunnel repairs at 2 the university of northern Iowa. The division also allows 3 moneys appropriated from the rebuild Iowa infrastructure fund 4 to the department of public defense for a readiness center 5 in FY 2021-2022 and FY 2022-2023 to not revert but to remain 6 available for expenditure until the project is completed. The 7 division takes effect upon enactment. 8 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 9 8.57C, concerning the technology reinvestment fund, is amended 10 to provide that the standing appropriation to the fund from the 11 general fund for fiscal years beginning on or after July 1, 12 2023, is changed to fiscal years beginning on or after July 1, 13 2024, and to provide for an appropriation to the fund from the 14 rebuild Iowa infrastructure fund for the fiscal year beginning 15 July 1, 2023, of $18.4 million. 16 DIVISION V —— DESTINATION IOWA FUND. New Code section 17 15.281 establishes a destination Iowa fund under the control 18 of the economic development authority. The bill provides 19 that moneys in the fund will be appropriated to the authority 20 for providing grants to eligible cities, counties, and 21 not-for-profit organizations to fund projects that increase 22 tourism opportunities, development and enhancement of outdoor 23 recreational opportunities, or otherwise contribute to 24 quality of life in rural communities. The bill defines rural 25 communities as a community that has a population of fewer than 26 20,000 persons as determined by the most recent population 27 estimate produced by the United States bureau of census or the 28 most recent decennial census released by the United States 29 bureau of census. The bill further provides that projects 30 must be primarily vertical infrastructure and available for 31 year-round use by the public, and provides that the applicant 32 for project moneys must intend to own the property that is 33 the subject of the project upon completion. The bill also 34 provides that the economic development authority shall allocate 35 -19- LSB 1008YC (6) 90 ec/rh 19/ 20
H.F. _____ 50 percent of the moneys available in the destination Iowa 1 fund at the beginning of each fiscal year to projects in rural 2 communities, but may reallocate any portion of the moneys 3 allocated to rural communities for all eligible projects if 4 moneys allocated for rural communities have not been awarded 5 by April 1 of the fiscal year for which the allocation is 6 made. The bill establishes the application process for grants 7 from the new fund and provides that the economic development 8 authority board shall make final funding decisions. The bill 9 provides that interest or earnings on moneys deposited in the 10 destination Iowa fund shall be credited to the destination Iowa 11 fund and moneys credited to the destination Iowa fund shall not 12 revert at the close of a fiscal year. The bill provides that 13 the economic development authority shall not use more than 5 14 percent of the moneys in the fund each fiscal year for purposes 15 of administrative costs and program support. 16 DIVISION VI —— ON-STREAM IMPOUNDMENT RESTORATION. This 17 division amends Code section 456A.33C, creating the on-stream 18 impoundment fund, by eliminating the fund and creating an on- 19 stream impoundment restoration program.
