NEW SECTION . 453A.13A Inspections of violations 1 of retailers. 2 As a condition for issuance of a permit to, and as a 3 condition of the continued holding of a valid permit by, 4 a retailer as defined in sections 453A.1 and 453A.42, the 5 applicant or holder must give consent to members of the fire, 6 police, and health departments and the building inspector of 7 cities; the county sheriff or deputy sheriff; members of the 8 department of public safety; representatives of the department 9 of revenue and of the department of inspections and appeals; 10 certified police officers; and any official county health 11 officer to enter upon areas of the premises where cigarettes, 12 tobacco, tobacco products, alternative nicotine products, or 13 vapor products are possessed, stored, offered for sale, sold, 14 or otherwise distributed to consumers without a warrant during 15 business hours of the permittee to inspect for violations of 16 this chapter or ordinances and regulations that cities and 17 boards of supervisors may adopt. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill provides that as a condition of issuance of a 22 permit to, and as a condition of the continued holding of a 23 valid permit by, a retailer, the applicant or holder must give 24 consent to members of the fire, police, and health departments 25 and the building inspector of cities; the county sheriff or 26 deputy sheriff; members of the department of public safety; 27 representatives of the department of revenue and the department 28 of inspections and appeals; certified police officers; and 29 any official county health officer to enter upon areas of 30 the premises where cigarettes, tobacco, tobacco products, 31 alternative nicotine products, or vapor products are possessed, 32 stored, offered for sale, sold, or otherwise distributed to 33 consumers without a warrant during business hours of the 34 permittee to inspect for violations of Code chapter 453A 35 -1- LSB 2175YC (4) 90 pf/jh 1/ 2
