is
amended
by
adding
the
following
new

subsection:

SUBSECTION
.
3A.
A
public
utility,
as
defined
in
section
4
476.1,
that
applies
for
an
electric
fuel
dealer
license
or
an
5
electric
fuel
user
license
shall
do
so
only
through
a
separate,
6
non-rate-regulated
affiliate
that
cannot
be
cross-subsidized;
7
cannot
receive
any
unfair
competitive
advantage
by
any
rate,
8
fee,
or
charge
associated
with
the
public
utility’s
regulated
9
service
offerings;
and
cannot
use
electricity
for
charging
10
under
different
fees,
terms,
rates,
charges,
and
conditions
11
than
those
offered
to
other
licensed
electric
fuel
dealers
or
12
other
licensed
electric
fuel
users,
pursuant
to
the
public
13
utility’s
approved
tariffs.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s

by
the
members

the
general
assembly.

In
2019,
the
general
assembly
passed
legislation
relating
18
to
an
excise
tax
on
electricity
used
as
electric
fuel
in
motor
19
vehicles,
including
by
providing
for
electric
fuel
dealer
and
20
user
licenses.
That
legislation
takes
effect
July
1,
2023.

This
bill
amends
the
2019
legislation
to
require
a
public
22
utility
that
applies
for
an
electric
fuel
dealer
license
or
23
an
electric
fuel
user
license
to
make
such
application
only
24
through
a
separate,
non-rate-regulated
affiliate
that
cannot
25
be
cross-subsidized;
cannot
receive
any
unfair
competitive
26
advantage
by
any
rate,
fee,
or
charge
associated
with
the
27
public
utility’s
regulated
service
offerings;
and
cannot
use
28
electricity
for
charging
under
different
fees,
terms,
rates,
29
charges,
and
conditions
than
those
offered
to
other
licensed

electric
fuel
dealers
or
other
licensed
electric
fuel
users,

pursuant
to
the
public
utility’s
approved
tariffs.
