Section
1.
Section
362.10,
Code
2023,
is
amended
by
striking
1
the
section
and
inserting
in
lieu
thereof
the
following:

362.10
Police
officers
and
fire
fighters.

The
maximum
age
for
a
regular
law
enforcement
officer,
as
4
defined
in
section
80B.3,
police
officer,
or
marshal,
employed
5
full-time
or
part-time
for
police
or
law
enforcement
duties,
6
or
a
paid
professional
fire
fighter,
employed
full-time
7
or
part-time
for
the
duty
of
fighting
fires,
is
sixty-five
8
years
of
age.
This
section
does
not
apply
to
a
reserve
peace
9
officer,
as
defined
in
section
80D.1A,
or
to
a
volunteer
fire
10
fighter.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
12
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
maximum
employment
age
for
certain
17
city
public
safety
positions.
Under
current
law,
the
maximum
18
age
for
a
city
police
officer,
marshal,
or
fire
fighter
19
employed
for
police
duty
or
the
duty
of
fighting
fires
is
65
20
years
of
age.
The
maximum
employment
age
does
not
apply
to
21
volunteer
fire
fighters.
The
bill
sets
a
maximum
employment
22
age
of
65
for
city
law
enforcement
officers,
in
addition
to
23
those
positions
currently
subject
to
the
maximum
employment
24
age,
and
provides
that
the
maximum
employment
age
applies
25
to
any
included
position
regardless
of
whether
the
person's
26
employment
is
full-time
or
part-time.
The
bill
states
that
the
27
maximum
employment
age
does
not
apply
to
reserve
peace
officers
28
in
addition
to
volunteer
fire
fighters.
29
The
bill
takes
effect
upon
enactment.
