H.F. _____ Section 1. Section 8B.21, subsection 1, paragraph f, 1 subparagraph (3), Code 2023, is amended to read as follows: 2 (3) Requiring all information technology security services, 3 solutions, hardware, and software purchased or used by a 4 participating agency to be subject to approval by the office 5 in accordance with security standards. A software licensing 6 contract for a participating agency’s or other governmental 7 entity’s desktop computers or servers shall not impede the 8 agency’s or governmental entity’s ability to utilize additional 9 software or hardware. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill prohibits a software licensing contract from 14 restricting a participating agency or other governmental entity 15 from enabling additional software or hardware on that agency or 16 governmental entity’s equipment. 17 -1- LSB 1253YC (2) 90 es/rn 1/ 1
