1.
Section
137F.6,

amended
to
read
as
follows:

For
a
temporary
food
establishment
for
multiple

nonconcurrent
events
during
a
calendar
year,
one
annual

license
fee
of
two
hundred
dollars
for
each
establishment
on

a
countywide
statewide
basis.

h.
For
a
farmers
market
where
time/temperature
control
for
7
safety
food
is
sold
or
distributed,
one
annual
license
fee
8
of
one
hundred
fifty
dollars
for
each
vendor
on
a
countywide
9
statewide
basis.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
11
importance,
takes
effect
upon
enactment.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
for
the
licensure
of
certain
food
16
establishments
under
the
regulatory
jurisdiction
of
the
17
department
of
inspections
and
appeals
(DIA)
or
a
political
18
subdivision
that
has
entered
into
a
contract
with
DIA
(together
19
termed
a
“regulatory
authority”)
under
Code
chapter
137F.
20
Specifically,
the
bill
amends
provisions
for
a
temporary
food
21
establishment
that
operates
for
not
more
than
14
consecutive
22
days
in
conjunction
with
a
single
event
and
at
multiple
23
nonconcurrent
events
during
a
calendar
year
(Code
sections
24
137F.1
and
137F.6).
The
license
fee
is
$200.
A
farmers
market
25
is
subject
to
regulation
as
a
food
establishment
if
its
vendor
26
sells
unpackaged
foods
that
must
be
temperature
controlled
such
27
as
meat,
poultry,
dairy
products,
cooked
or
prepared
foods,
28
or
soft
pies
requiring
refrigeration
(see
481
IAC
31.5).
The
29
license
fee
is
$150.
In
each
case,
the
license
is
valid
on
a
30
countywide
basis.
The
bill
amends
Code
section
137F.6(1)
by
31
providing
that
the
license
is
valid
on
a
statewide
basis.

The
bill
takes
effect
upon
enactment.
