Section
1.
NEW
SECTION
.
321.260A
Rumble
strips.
1
1.
As
used
in
this
section,
“rumble
strips”
means
a
series
2
of
rough-textured,
slightly
raised
or
depressed
grooves
3
along
the
surface
of
a
roadway
used
to
alert
motor
vehicle
4
operators
about
upcoming
road
conditions,
including
an
upcoming
5
traffic-control
signal
or
device.
6

Any
governmental
entity
which
exercises
jurisdiction
7
over
a
highway
under
section
306.4
shall
construct
and
maintain
8
rumble
strips
in
advance
of
all
stop
signs
and
traffic-control
9
signals
located
on
a
highway
under
the
governmental
entity’s
10
control
where
the
highway
enters
or
crosses
a
primary
highway.
11
This
subsection
does
not
apply
if
the
segment
of
the
highway
12
on
which
the
rumble
strips
would
be
constructed
is
unpaved,
13
is
inside
the
limits
of
any
incorporated
city,
is
within
two
14
hundred
yards
of
a
person’s
bona
fide
residence
dwelling,
or
15
has
a
speed
limit
of
less
than
fifty-five
miles
per
hour.

Sec.
2.
STATE
MANDATE
FUNDING
SPECIFIED.
In
accordance
17
with
section
25B.2,
subsection
3,
the
state
cost
of
requiring
18
compliance
with
any
state
mandate
included
in
this
Act
shall
19
be
paid
by
a
political
subdivision
from
road
use
tax
fund
20
moneys
received
by
the
political
subdivision
under
chapter
310,
21
312,
or
312A.
This
specification
of
the
payment
of
the
state
22
cost
shall
be
deemed
to
meet
all
of
the
state
funding-related
23
requirements
of
section
25B.2,
subsection
3,
and
no
additional
24
state
funding
shall
be
necessary
for
the
full
implementation
of
25
this
Act
by
and
enforcement
of
this
Act
against
all
affected
26
political
subdivisions.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
any
governmental
entity
which
exercises
31
jurisdiction
over
a
highway
to
construct
and
maintain
rumble
32
strips
on
certain
highways.
The
bill
defines
the
term
“rumble
33
strips”.
Under
the
bill,
rumble
strips
are
required
in
advance
34
of
all
stop
signs
and
traffic-control
signals
located
on
a

highway
where
the
highway
enters
or
crosses
a
primary
highway.

However,
rumble
strips
are
not
required
if
the
segment
of

highway
is

is
inside
the

yards
of
a
person’s
bona
fide
residence

dwelling,
or
has
a
speed
limit
of

than
55
miles
per
hour.

The
bill
may
include
a
state
mandate
as
defined
in
Code

section
25B.3.
The
bill
requires
that
the
state
cost
of
any

state
mandate
included
in
the
bill
be
paid
by
a
political
8
subdivision
from
road
use
tax
fund
moneys
received
by
9
the
political
subdivision.
The
specification
is
deemed
10
to
constitute
state
compliance
with
any
state
mandate
11
funding-related
requirements
of
Code
section
25B.2.
The
12
inclusion
of
this
specification
is
intended
to
reinstate
the
13
requirement
of
political
subdivisions
to
comply
with
any
state
14
mandates
included
in
the
bill.
