“Criminal
or
juvenile
justice
agency”
means
an
agency

or
department
of
any
level
of
government
or
an
entity
wholly

owned,
financed,
or
controlled
by
one
or
more
such
agencies
5
or
departments
,
or
a
federally
recognized
Indian
tribe
which
6
has
entered
into
a
written
agreement
with
the
department
7
irrevocably
waiving
any
tribal
sovereign
immunity
related
to
8
the
dissemination
or
use
of
criminal
history
data
obtained
9
because
of
that
written
agreement,
which
performs
as
its
10
principal
function
the
apprehension,
prosecution,
adjudication,
11
incarceration,
or
rehabilitation
of
criminal
or
juvenile

offenders.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
criminal
history
and
intelligence
data.

The
bill
provides
that
a
“criminal
or
juvenile
justice
18
agency”
includes
a
federally
recognized
Indian
tribe
which
19
has
entered
into
a
written
agreement
with
the
department
of
20
public
safety
irrevocably
waiving
any
tribal
sovereign
immunity
21
related
to
the
dissemination
or
use
of
criminal
history
data
22
obtained
because
of
that
written
agreement,
which
performs
23
as
its
principal
function
the
apprehension,
prosecution,
24
adjudication,
incarceration,
or
rehabilitation
of
criminal
25
or
juvenile
offenders.
Under
current
law,
the
department
of
26
public
safety
may
provide
copies
or
communicate
information
27
from
criminal
history
data
to
a
criminal
or
juvenile
justice
28
agency.
Criminal
history
data
includes
data
concerning
29
arrests,
convictions,
dispositions,
corrections,
adjudications,
30
and
custody.
