juvenile
justice
agency”
means
an
either
of

the
following:

a.
An
agency
or
department
of
any
level
of
government

or
an
entity
wholly
owned,
financed,
or
controlled
by
one

or
more
such
agencies
or
departments
which
performs
as
its

principal
function
the
apprehension,
prosecution,
adjudication,

incarceration,
or
rehabilitation
of
criminal
or
juvenile
9
offenders.

b.
County
attorneys
and
assistant
county
attorneys
in

a
proceeding
alleging
that
a
child
is
a
child
in
need
of
12
assistance
as
defined
in
section
232.2.

inclusion
of
this
explanation
does

the

This
bill
relates
to
access
to
criminal
history
and

intelligence
data
in
child
in
need
of
assistance
proceedings.

The
bill
adds
to
the
definition
of
“criminal
or
juvenile
19
justice
agency”
(relating
to
the
provision
of
criminal
history
20
and
intelligence
data
under
Code
chapter
692)
county
attorneys
21
and
assistant
county
attorneys
in
a
proceeding
alleging
that
a
22
child
is
a
child
in
need
of
assistance.

For
purposes
of
Code
chapter
692,
“criminal
history
data”
24
means
any
or
all
of
the
following
information
maintained
by
25
the
department
of
public
safety
or
the
division
of
criminal
26
investigation
of
the
department
of
public
safety
in
a
manual
or
27
automated
data
storage
system
that
is
individually
identified:
28
arrest
data,
conviction
data,
disposition
data,
correctional
29
data,
adjudication
data,
and
custody
data;
and
“intelligence
30
data”
means
information
on
identifiable
individuals
compiled
in
31
an
effort
to
anticipate,
prevent,
or
monitor
possible
criminal

activity.
