H.F. 516 Section 1. Section 91D.1, subsection 1, paragraph b, Code 1 2023, is amended to read as follows: 2 b. Every employer, as defined in the federal Fair Labor 3 Standards Act of 1938, as amended to January 1, 2007 July 1, 4 2023 , shall pay to each of the employer’s employees, as defined 5 in the federal Fair Labor Standards Act of 1938, as amended to 6 January 1, 2007 July 1, 2023 , the state hourly wage stated in 7 paragraph “a” provided in this chapter , or the current federal 8 minimum wage, pursuant to 29 U.S.C. §206, as amended, whichever 9 is greater. 10 Sec. 2. Section 91D.1, subsections 4, 5, and 6, Code 2023, 11 are amended to read as follows: 12 4. For purposes of this chapter section , “employee” does 13 not include an independent contractor as described in section 14 85.61, subsection 12 , paragraph “c” , subparagraph (3). 15 5. The labor commissioner shall adopt rules to implement and 16 administer this section chapter . 17 6. This section chapter shall be enforced pursuant to 18 chapter 91A . 19 Sec. 3. NEW SECTION . 91D.2 Minimum wage —— education 20 support professionals. 21 1. For purposes of this section, “education support 22 professional” means an employee of a public, nonpublic, or 23 charter school who meets the needs of the whole student, 24 promotes quality education, and fosters a positive learning 25 environment, including an employee who provides the following 26 services or functions: 27 a. Clerical services. 28 b. Custodial, building grounds, and maintenance services. 29 c. Food services. 30 d. Health service providers other than school nurses. 31 e. Para-educators. 32 f. Notwithstanding section 91D.1, the state hourly wage for 3 an employee employed as an education support professional shall 4 be at least $17.00 as of July 1, 2023. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill provides that the state minimum hourly wage for 9 education support professionals, as defined in the bill, shall 10 be $17.00 as of July 1, 2023. 11 -2- LSB 2422YH (2) 90 je/rn 2/ 2
