H.F. 511 Section 1. Section 455B.172, subsection 11, paragraph 1 a, Code 2023, is amended by adding the following new 2 subparagraphs: 3 NEW SUBPARAGRAPH . (13) A change in the business entity 4 owning the property if such change results in the same 5 persons or immediate family members of such persons owning 6 the property. For purposes of this subparagraph, “immediate 7 family member” means a spouse, child, stepchild, brother, 8 brother-in-law, stepbrother, sister, sister-in-law, stepsister, 9 parent, parent-in-law, or stepparent. 10 NEW SUBPARAGRAPH . (14) The subdivision of a property that 11 was previously held jointly. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the inspection of a private sewage 16 disposal system for certain transactions. Under current law, 17 if a building where a person resides, congregates, or is 18 employed is served by a private sewage disposal system, the 19 sewage disposal system serving the building shall be inspected 20 prior to any transfer of ownership of the building. The bill 21 provides two exceptions to the definition of “transfer”. Under 22 the bill, a transfer does not include a change in the business 23 entity owning the property if such change results in the same 24 persons or immediate family members of such persons owning the 25 property, nor does a transfer include the subdivision of a 26 property that was previously held jointly. 27 -1- LSB 1449YH (2) 90 js/ns 1/ 1
