H.F. 51 Section 1. DEPARTMENT OF HEALTH AND HUMAN SERVICES —— CHILD 1 CARE ASSISTANCE. The department of health and human services 2 shall adopt rules pursuant to chapter 17A to require that state 3 child care assistance program payments be made to a child care 4 provider for the time a child is regularly scheduled to receive 5 child care at a child care facility regardless of whether 6 the child is in attendance on those regularly scheduled days 7 provided that the child care provider would charge a private 8 individual for the scheduled child care. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill relates to child care assistance payments for 13 children who are absent from regularly scheduled child care 14 days. 15 The bill directs the department of health and human services 16 to amend its rules to require that state child care assistance 17 program payments be made to a child care provider for the 18 time a child is regularly scheduled to receive child care at 19 a child care facility regardless of whether the child is in 20 attendance during those regularly scheduled days provided that 21 the child care provider would charge a private individual for 22 the scheduled child care. 23 -1- LSB 1149YH (2) 90 dg/rh 1/ 1
