H.F. 414 Section 1. Section 249A.29, subsection 1, Code 2023, is 1 amended to read as follows: 2 1. For purposes of this section and section 249A.30 unless 3 the context otherwise requires: 4 a. “Consumer” means an individual approved by the department 5 to receive services under a waiver. 6 b. “Provider” means an agency certified by the department to 7 provide services under a waiver. 8 c. “Services” means services provided under a waiver 9 including but not limited to habilitation services, the program 10 of all-inclusive care for the elderly services, home health 11 services, hospice services, targeted case management, and money 12 follows the person services. 13 c. d. “Waiver” means a home and community-based services 14 waiver approved by the federal government and implemented under 15 the medical assistance program. 16 Sec. 2. Section 335.34, subsection 4, Code 2023, is amended 17 to read as follows: 18 4. For the purposes of this section , “home and 19 community-based services waiver” : 20 a. “Home and community-based services waiver” means “waiver” 21 as defined in section 249A.29 . 22 b. “Services” means services as defined in section 249A.29. 23 Sec. 3. Section 414.32, subsection 4, Code 2023, is amended 24 to read as follows: 25 4. For the purposes of this section , “home and 26 community-based services waiver” : 27 a. “Home and community-based services waiver” means “waiver” 28 as defined in section 249A.29 . 29 b. “Services” means services as defined in section 249A.29. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 This bill provides that, relative to Medicaid home and 34 community-based services (HCBS) waiver services and providers 35 -1- LSB 2381YH (3) 90 pf/rh 1/ 2
