H.F. 411 Section 1. Section 321.105, subsection 5, Code 2023, is 1 amended to read as follows: 2 5. a. Seriously disabled veterans who have been provided 3 with an automobile or other vehicle by the United States 4 government under the provisions of 38 U.S.C. §3901 3904, 5 shall be exempt from payment of the registration fee provided 6 in this chapter for that vehicle, and shall be provided, 7 without fee, with one set of regular registration plates or 8 one set of any type of special registration plates associated 9 with service in the United States armed forces for which 10 the disabled veteran qualifies under section 321.34 . The 11 disabled veteran, to be able to claim the benefit, must be a 12 resident of the state of Iowa. In lieu of the set of regular 13 or special military registration plates available without fee, 14 the disabled veteran may obtain a set of nonmilitary special 15 registration plates or personalized plates issued under section 16 321.34 by paying the additional fees associated with those 17 plates. 18 b. A disabled veteran with a disability rating of one 19 hundred percent as determined by the United States department 20 of veterans affairs, whether service-related or not, shall be 21 exempt from payment of the registration fees provided in this 22 chapter for one vehicle, and shall be provided, without fee, 23 with one set of regular registration plates or one set of any 24 type of special registration plates associated with service in 25 the United States armed forces for which the disabled veteran 26 qualifies under section 321.34. The disabled veteran, to be 27 able to claim the benefit, must be a resident of the state 28 of Iowa. In lieu of the set of regular or special military 29 registration plates available without fee, the disabled veteran 30 may obtain a set of nonmilitary special registration plates or 31 personalized plates issued under section 321.34 by paying the 32 additional fees associated with those plates. H.F. 411 one-year period prior to July 1, 2023, the disabled veteran may 1 continue to use the plates without paying the additional fees 2 associated with those plates. 3 Sec. 2. Section 321L.2, subsection 1, paragraph a, 4 subparagraph (2), Code 2023, is amended to read as follows: 5 (2) Persons with disabilities parking sticker. An 6 applicant who owns a motor vehicle for which the applicant 7 has been issued registration plates under section 321.34 or 8 registration plates as a seriously disabled veteran under 9 section 321.105 may apply to the department for a persons with 10 disabilities parking sticker to be affixed to the plates. The 11 persons with disabilities parking stickers shall bear the 12 international symbol of accessibility. 13 Sec. 3. Section 321L.2, subsection 5, Code 2023, is amended 14 to read as follows: 15 5. A seriously disabled veteran who has been provided with 16 an automobile or other vehicle by the United States government 17 under the provisions of 38 U.S.C. §3901 3904 , or a disabled 18 veteran with a disability rating of one hundred percent as 19 determined by the United States department of veterans affairs, 20 whether service-related or not, is not required to apply for 21 a persons with disabilities parking permit under this section 22 unless the veteran has been issued special registration 23 plates or personalized plates for the vehicle. The regular 24 registration plates issued for the disabled veteran’s vehicle 25 without fee pursuant to section 321.105 entitle the disabled 26 veteran to all of the rights and privileges associated with 27 persons with disabilities parking permits under this chapter . 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 Current law exempts seriously disabled veterans who have 32 been provided with an automobile or other vehicle by the United 33 States government from paying motor vehicle registration fees 34 and applying for a persons with disabilities parking permit. 35 -2- LSB 1099YH (2) 90 th/ns 2/ 3
H.F. 411 This bill broadens these exemptions to include disabled 1 veterans with a disability rating of 100 percent as determined 2 by the United States department of veterans affairs, regardless 3 of whether the disability is service-related. 4 The bill provides such disabled veterans with one free set 5 of regular registration plates or one free set of any type of 6 special registration plates associated with service in the 7 United States armed forces for which the disabled veteran 8 qualifies under Code section 321.34. The bill requires the 9 disabled veteran to be a resident of the state of Iowa. In lieu 10 of the set of regular or special military registration plates 11 available without fee, the disabled veteran may obtain a set of 12 nonmilitary special registration plates or personalized plates 13 by paying the additional fees associated with those plates. 14 However, if the veteran was issued or reassigned such plates 15 prior to July 1, 2023, the veteran may continue to use the 16 plates without paying the additional fees. 17 By operation of law, Code section 321.166 requires the 18 registration plates provided under the bill to display the 19 alphabetical characters “DV” preceding the registration plate 20 number. 21 -3- LSB 1099YH (2) 90 th/ns 3/ 3
