H.F. 410 Section 1. Section 479B.4, subsection 1, Code 2023, is 1 amended to read as follows: 2 1. A pipeline company doing business in this state shall , 3 subject to subsection 7, file a verified petition with the 4 board asking for a permit to construct, maintain, and operate 5 a new pipeline along, over, or across the public or private 6 highways, grounds, waters, and streams of any kind in this 7 state. Any pipeline company now owning or operating a pipeline 8 or underground storage facility in this state shall be issued a 9 permit by the board upon supplying the information as provided 10 for in section 479B.5, subsections 1 through 5 , and meeting the 11 requirements of section 479B.13 . 12 Sec. 2. Section 479B.4, Code 2023, is amended by adding the 13 following new subsection: 14 NEW SUBSECTION . 7. The board shall not grant a permit to a 15 pipeline company for a pipeline transporting liquefied carbon 16 dioxide. 17 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 18 importance, takes effect upon enactment. 19 Sec. 4. APPLICABILITY. This Act applies to pipeline 20 companies that have yet to be granted a permit from the board 21 on or after the effective date of this Act. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to prohibiting hazardous liquid pipelines 26 transporting liquefied carbon dioxide. 27 The bill prohibits the Iowa utilities board from issuing 28 a permit for a pipeline company constructing a pipeline 29 transporting liquefied carbon dioxide in the state. 30 The bill takes effect upon enactment and applies to pipeline 31 companies that have yet to be granted a permit from the Iowa 32 utilities board on or after the effective date of the bill. 33 -1- LSB 1948YH (5) 90 es/rn 1/ 1
