Section
1.
Section
280.13A,
subsection
1,
Code
2023,
is
1
amended
to
read
as
follows:

1.
If
a
school
district
or
nonpublic
school
does
not
provide
3
an
interscholastic
activity
for
its
students,
the
board
of
4
directors
of
that
school
district
or
the
authorities
in
charge
5
of
the
nonpublic
school
may
shall
complete
an
agreement
with
6
another
school
district
or
nonpublic
school
to
provide
for
7
the
eligibility
of
its
students
in
interscholastic
activities
8
provided
by
that
other
school
district
or
nonpublic
school.
A
9
copy
of
each
agreement
completed
under
this
section
shall
be
10
filed
with
the
appropriate
organization
as
organization
is
11
defined
in
section
280.13
not
later
than
April
30
of
the
school
12
year
preceding
the
school
year
in
which
the
agreement
takes
13
effect,
unless
an
exception
is
granted
by
the
organization
for
14
good
cause.
An
agreement
completed
under
this
section
shall
15
be
deemed
approved
unless
denied
by
the
governing
organization
16
within
ten
days
after
its
receipt.
A
governing
organization
17
shall
determine
whether
an
agreement
would
substantially
18
prejudice
the
interscholastic
activities
of
other
schools.
An
19
agreement
denied
by
a
governing
organization
under
this
section
20
may
be
appealed
to
the
state
board
of
education
under
chapter
21
290
.

constitute
agreement
with

substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
interscholastic
activities
provided
by

school
districts
and
nonpublic
schools.

Current
Code
section
280.13A
provides
that
if
a
28
school
district
or
nonpublic
school
does
not
provide
an
29
interscholastic
activity
for
its
students,
the
board
of
30
directors
of
that
school
district
or
the
authorities
in
31
charge
of
the
nonpublic
school
may
complete
an
agreement
with
32
another
school
district
or
nonpublic
school
to
provide
for
33
the
eligibility
of
its
students
in
interscholastic
activities
34
provided
by
that
other
school
district
or
nonpublic
school.

The
bill
modifies
this
provision
to
require
the
school
district
1
or
nonpublic
school
that
does
not
provide
an
interscholastic
2
activity
to
complete
an
agreement
with
another
school
district
3
or
nonpublic
school
to
provide
for
the
eligibility
of
its
4
students
in
interscholastic
activities
provided
by
that
other
5
school
district
or
nonpublic
school.
The
bill
does
not
affect
6
the
authority
of
an
organization
to
deny
such
an
agreement
if
7
the
agreement
would
substantially
prejudice
the
interscholastic
8
activities
of
other
schools.
For
purposes
of
Code
section
9
280.13A,
“organization”
means
an
organization
which
has
as
10
one
of
its
primary
purposes
the
sponsoring
or
administration
11
of
extracurricular
interscholastic
athletic
contests
or
12
competitions,
but
does
not
include
an
agency
of
this
state,
13
a
public
or
private
school
or
school
board,
or
an
athletic
14
conference
or
other
association
whose
interscholastic
contests
15
or
competitions
do
not
include
more
than
24
schools.
