H.F. 39 Section 1. NEW SECTION . 256E.13 Extracurricular athletic 1 activities. 2 1. If a charter school established pursuant to this chapter 3 does not offer a particular extracurricular athletic activity, 4 a student enrolled in the charter school may participate in the 5 extracurricular athletic activity provided by the student’s 6 school district of residence as a member of a team from the 7 student’s school district of residence. 8 2. If a student participates in an extracurricular athletic 9 activity provided by the student’s school district of residence 10 pursuant to this section, the student shall be included in the 11 school district’s basic enrollment under section 257.6 and 12 shall be counted as one-tenth of one pupil for purposes of 13 section 257.6. 14 3. The state board may adopt rules pursuant to chapter 17A 15 to administer this section. 16 Sec. 2. Section 257.6, subsection 1, paragraph a, Code 2023, 17 is amended by adding the following new subparagraph: 18 NEW SUBPARAGRAPH . (10) In addition to subparagraph (9), 19 resident pupils enrolled in a charter school under chapter 256E 20 who participate in extracurricular athletic activities pursuant 21 to section 256E.13 shall be counted as one-tenth of one pupil. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill authorizes students enrolled in charter schools 26 to participate in extracurricular athletic activities provided 27 by the student’s school district of residence as a member of 28 a team from the student’s school district of residence if the 29 charter school does not offer the extracurricular athletic 30 activity. The bill provides that such students shall be 31 included in the school district’s basic enrollment and shall be 32 counted as one-tenth of one pupil for school funding purposes. 33 The bill also authorizes the state board of education to adopt 34 rules to administer this provision. 35 -1- LSB 1127YH (4) 90 jda/jh 1/ 1
