H.F. 300 Section 1. NEW SECTION . 455B.280 Sale of water to persons 1 outside the state —— reports. 2 By January 31 of each year, an entity that sells water 3 withdrawn in this state to a person outside the state shall 4 submit to the department a report detailing the amount of water 5 that the entity withdrew in this state and sold to a person 6 outside the state in the previous calendar year. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to the sale of water to a person outside 11 the state. The bill requires an entity that sells water 12 withdrawn in this state to a person outside the state to submit 13 to the department of natural resources, by January 31 of each 14 year, a report detailing the amount of water that the entity 15 withdrew in this state and sold to a person outside the state 16 in the previous calendar year. By operation of law, a person 17 who violates the bill is subject to civil enforcement, which 18 may include a civil penalty not to exceed $500 for each day a 19 violation occurs. 20 -1- LSB 2065YH (3) 90 js/rn 1/ 1
