H.F. 275 Section 1. MEDICAID INTELLECTUAL DISABILITY HOME 1 AND COMMUNITY-BASED SERVICES WAIVER —— HOME AND VEHICLE 2 MODIFICATIONS —— ANNUAL SERVICES CAP. The department of health 3 and human services shall eliminate the lifetime maximum cap and 4 instead establish and maintain a home and vehicle modifications 5 services annual maximum cap per waiver member year for the 6 Medicaid intellectual disability home and community-based 7 services waiver to reflect the same amount as that for the 8 home and vehicle modifications services annual maximum cap 9 per waiver member year for the Medicaid brain injury home 10 and community-based services waiver. The department shall 11 continue to require that any home and vehicle modifications are 12 medically necessary and are subject to prior authorization by 13 the department. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill requires the department of health and human 18 services (HHS) to eliminate the lifetime maximum cap and 19 instead establish and maintain a home and vehicle modifications 20 services annual maximum cap per waiver member year for the 21 Medicaid intellectual disability home and community-based 22 services (HCBS) waiver to reflect the same amount as that for 23 the home and vehicle modifications services annual maximum cap 24 for the Medicaid brain injury HCBS waiver. The department 25 shall continue to require that any such modifications are 26 medically necessary and are subject to prior authorization by 27 HHS. 28 For fiscal year 2022-2023, the home and vehicle 29 modifications lifetime maximum cap for the intellectual 30 disability HCBS waiver is $5,727.37 and the annual maximum cap 31 for the brain injury HCBS waiver is $6,872.85. 32 -1- LSB 1435HV (1) 90 pf/rh 1/ 1
