Section
1.
Section
99B.1,
Code
2023,
is
amended
by
adding
1
the
following
new
subsections:

NEW
SUBSECTION
.
2A.
“Amusement
park”
means
any
permanent
3
facility
or
park
where
amusement
rides,
as
defined
in
section
4
88A.1,
are
available
for
use
by
the
public.

NEW
SUBSECTION
.
3A.
“Arcade”
means
any
permanent
facility
6
or
a
distinct
part
of
a
permanent
facility
principally
devoted
7
to
offering
amusement
or
entertainment
by
means
of
amusement
8
concessions
or
nongambling
games.

Sec.
2.
Section
99B.5,
subsection
2,
Code
2023,
is
amended
10
to
read
as
follows:

2.
Except
as
provided
by
subsection
1
,
a
participant
in
12
an
activity
authorized
by
this
chapter
may
make
payment
by
13
cash,
personal
check,
money
order,
bank
check,
cashier’s
check,
14
electronic
check,
or
debit
card.
In
addition,
a
participant
in
15
an
amusement
concession
as
authorized
by
this
chapter
at
a
fair
16
as
authorized
by
this
chapter
,
amusement
park,
or
arcade,
may
17
also
make
payment
by
credit
card.

Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
19
importance,
takes
effect
upon
enactment.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
participant
in
an
amusement
24
concession
as
authorized
by
Code
chapter
99B
at
an
amusement
25
park
or
an
arcade
may
also
make
payment
by
credit
card.
For
26
purposes
of
Code
chapter
99B,
the
bill
defines
“amusement
park”
27
as
any
permanent
facility
where
amusement
rides
are
available
28
for
use
by
the
public,
and
“arcade”
as
any
permanent
facility
29
devoted
to
offering
amusement
or
entertainment
by
means
of
30
amusement
concessions
or
nongambling
games.
31
The
bill
takes
effect
upon
enactment.
