Section
477A.1,
subsection
16,
Code
2023,
is

amended
to
read
as
follows:

16.
“Video
service”
means
video
programming
services

provided
by
a
competitive
video
service
provider
through
4
wireline
facilities
owned,
controlled,
constructed,
or
operated
5
by
the
provider
of
such
video
service
and
located
at
least
in
6
part
in
the
public
right-of-way
without
regard
to
delivery
7
technology,
including
internet
protocol
technology.
“Video
8
service”
does
not
include
any
video
of
the
following:
9
a.
Video
programming
provided
by
a
provider
of
commercial
10
mobile
service
as
defined
in
47
U.S.C.
§332
,
or
cable
.

b.
Cable
service
provided
by
an
incumbent
cable
provider
or
12
a
competitive
cable
service
provider
or
any
.
13
c.
Video
programming
provided
by
a
provider
of
14
direct-to-home
satellite
services
as
defined
in
47
U.S.C.
15
§303(v)
and
that
are
transmitted
from
a
satellite
directly
to
a
16
customer’s
premises
without
using
or
accessing
any
portion
of
17
the
public
right-of-way.

Any
video
programming
provided
solely
as
part
of,
and

accessed
via
,
a
service
that
enables
users
to
access
content,
20
information,
electronic
mail,
or
other
services
offered
over
21
the
public
internet
,
including
digital
audio-visual
works
.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
23
importance,
takes
effect
upon
enactment.

inclusion
of
this
explanation
does
not
constitute
agreement

the
members
of
the
general
assembly.

This
bill
modifies
the
definition
of
“video
service”

applicable
to
a
competitive
video
service
provider
applying
for

a
certificate
of
franchise
authority
to
provide
cable
and
video

services.

The
bill
excludes
video
programming
offered
by
a
provider
32
of
direct-to-home
satellite
services
as
video
service.
The
33
bill
also
excludes
digital
audio-visual
works
offered
over
the
34
internet
as
video
service.
