An insurer providing medical malpractice insurance 3 coverage to Iowa health care providers shall not increase 4 rates for medical malpractice insurance policies issued by the 5 insurer by more than two percent per year. 6 2. “Health care provider” and “insurer” mean the same as 7 defined in section 505.27. 8 Sec. 2. Section 519A.5, Code 2024, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 4A. The rates applicable to the medical 11 malpractice insurance policies written by the association shall 12 not increase by more than two percent per year. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to rate increases for medical malpractice 17 insurance policies. 18 The bill prohibits an insurer providing medical malpractice 19 insurance coverage to health care providers in this state 20 from increasing the rates applicable to medical malpractice 21 insurance policies issued by the insurer by more than 2 percent 22 per year. 23 The bill prohibits the joint underwriting association 24 from increasing the rates applicable to medical malpractice 25 insurance policies written by the association by more than 2 26 percent per year. 27 -1- LSB 5860YH (4) 90 nls/ko 1/ 1
