H.F. 2372 Section 1. Section 2.56, subsections 1 and 5, Code 2024, are 1 amended to read as follows: 2 1. Prior to debate on the floor of a chamber of the 3 general assembly, a correctional impact statement shall be 4 attached to any bill, joint resolution, or amendment which 5 proposes a change in the law which creates a public offense, 6 significantly changes an existing public offense or the penalty 7 for an existing offense, or changes existing sentencing, 8 parole, or probation procedures. The statement shall include 9 information concerning the estimated number of criminal cases 10 per year that the legislation will impact, the fiscal impact 11 of confining persons pursuant to the legislation, the impact 12 of the legislation on minorities including minorities who 13 are juveniles , the impact of the legislation upon existing 14 correctional institutions, community-based correctional 15 facilities and services, and jails, the likelihood that the 16 legislation may create a need for additional prison capacity, 17 and other relevant matters. The statement shall be factual 18 and shall, if possible, provide a reasonable estimate of both 19 the immediate effect and the long-range impact upon prison 20 capacity. 21 5. The legislative services agency, in cooperation with 22 the department of health and human services as the agency 23 responsible for criminal and juvenile justice planning, shall 24 develop a protocol for analyzing the impact of the legislation 25 on minorities including minorities who are juveniles . 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to correctional impact statements 30 regarding minorities who are juveniles. 31 Under current law, a correctional impact statement must 32 include the impact of legislation which proposes a change 33 in the law which creates a public offense, significantly 34 changes an existing public offense or the penalty for an 35 -1- LSB 6198YH (1) 90 sc/ns 1/ 2
H.F. 2372 existing offense, or changes existing sentencing, parole, or 1 probation procedures. The statement must include, among other 2 factors, information concerning the impact of the legislation 3 on minorities. The bill specifies the statement must also 4 include information concerning the impact of the legislation on 5 minorities who are juveniles. 6 Under current law, the legislative services agency, in 7 cooperation with the department of health and human services, 8 is required to develop a protocol for analyzing the impact 9 of the legislation on minorities.
