H.F. 2321 Section 1. Section 708.3A, subsection 5, paragraph d, Code 1 2024, is amended to read as follows: 2 d. “Health care provider” means an emergency medical care 3 provider as defined in chapter 147A or a person licensed 4 or registered under chapter 148 , 148C , 148D , or 152 who is 5 providing or who is attempting to provide emergency medical 6 services, as defined in section 147A.1 , or who is providing 7 or who is attempting to provide health services as defined in 8 section 10A.711 in working, volunteering, or participating 9 in an educational course of instruction at a hospital or 10 rural emergency hospital as defined in chapter 135B . A 11 person who commits an assault under this section against a 12 health care provider in a hospital, or at the scene or during 13 out-of-hospital patient transportation in an ambulance, is 14 presumed to know that the person against whom the assault is 15 committed is a health care provider. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to assaults on persons engaged in certain 20 occupations including a health care provider. 21 The bill amends the definition of “health care provider” to 22 include a person who is working, volunteering, or participating 23 in an educational course of instruction at a hospital or rural 24 emergency hospital. 25 An assault on a health care provider can result in penalties 26 including a serious misdemeanor, an aggravated misdemeanor, or 27 a class “D” felony. A serious misdemeanor is punishable by 28 confinement for no more than one year and a fine of at least 29 $430 but not more than $2,560. An aggravated misdemeanor is 30 punishable by confinement for no more than two years and a fine 31 of at least $855 but not more than $8,540. A class “D” felony 32 is punishable by confinement for no more than five years and a 33 fine of at least $1,025 but not more than $10,245. 34 -1- LSB 5816HV (1) 90 as/js 1/ 1
