1.
Section
26.14A,
Code
2024,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.

A
governmental
entity
may
use
a

prequalification
requirement,
specification
requirement,
or

a
procurement
evaluation
to
protect
the
public
interest
for
5
public
safety
infrastructure
to
be
constructed
for
or
public
6
safety
technology
to
be
purchased
by
the
governmental
entity,
7
including
for
traffic
control
devices,
cameras,
computers,
8
software,
unmanned
aerial
vehicles,
and
solar,
wind,
or
other
9
energy
infrastructure
or
technology,
through
the
limitation
10
on
or
preference
against
any
product,
technology,
software,
11
design,
or
company
from
a
country
that
is
not
a
member
of
the
12
north
Atlantic
treaty
organization.

Section
26.16,
Code
2024,
is
amended
to
read
as

Prequalification
requirements
prohibited.

1.
A
Except
to
the
extent
provided
in
subsection
2,
a
17
governmental
entity
shall
not
by
ordinance,
rule,
or
any
18
other
action
relating
to
contracts
for
public
improvements
19
for
which
competitive
bids
are
required
by
this
chapter
20
impose
any
requirement
that
directly
or
indirectly
restricts
21
potential
bidders
to
any
predetermined
class
of
bidders
defined
22
by
experience
on
similar
projects,
size
of
company,
union
23
membership,
or
any
other
criteria.
However,
a
governmental
24
entity
shall
require
nonresident
bidders
to
comply
with
section
25
8A.311B,
subsection
4
.

2.
A
governmental
entity
may
use
a
prequalification
27
requirement
to
disqualify
a
bid
involving
any
product,
28
technology,
software,
design,
or
company
from
a
country
that
29
is
not
a
member
of
the
north
Atlantic
treaty
organization
for
30
public
safety
infrastructure
to
be
constructed
for
or
public
31
safety
technology
to
be
purchased
by
the
governmental
entity,

including
for
traffic
control

cameras,
computers,

software,

1
The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members

the
general
assembly.

This
bill
relates
to
prequalification
requirements
for
the
4
construction
of
public
safety
infrastructure
for
and
purchase
5
of
public
safety
technology
by
a
governmental
entity.
Under
6
current
law,
a
governmental
entity
shall
not
impose
any
7
requirement
that
directly
or
indirectly
restricts
potential
8
bidders
to
a
predetermined
class
of
bidders
defined
by
certain
9
criteria.
The
bill
allows
a
governmental
entity
to
use
10
prequalification
requirements
to
limit
quotations
or
disqualify
11
bids
involving
any
product,
technology,
software,
design,
12
or
company
from
a
country
that
is
not
a
member
of
the
north
13
Atlantic
treaty
organization
for
the
construction
of
public
14
safety
infrastructure
for
or
the
purchase
of
public
safety
15
technology
by
the
governmental
entity.
