H.F. 2274 Section 1. Section 904.701, subsection 2, Code 2024, is 1 amended to read as follows: 2 2. a. The director may when practicable pay the inmate 3 an allowance as the director deems proper in view of the 4 circumstances, and in view of the cost attending the 5 maintenance of the inmate. The allowance is a gratuitous 6 payment and is not a wage arising out of an employment 7 relationship. The payment shall not exceed the amount paid to 8 free labor for a like or equivalent service. 9 b. The director shall, at least once every two years, 10 consider implementing a cost-of-living increase for inmates 11 involved in offender work programs under this section. 12 Sec. 2. Section 904.809, subsection 5, Code 2024, is amended 13 by adding the following new paragraph: 14 NEW PARAGRAPH . e. The director shall, at least once every 15 two years, consider implementing a cost-of-living increase for 16 inmates involved in offender work programs under this section. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to cost-of-living increases for inmates 21 committed to the custody of the department of corrections who 22 perform inmate work. 23 The bill provides that the director of the department of 24 corrections, at least once every two years, shall consider 25 implementing cost-of-living increases for inmates involved in 26 offender work programs. 27 -1- LSB 6038YH (3) 90 as/js 1/ 1
