Section
1.
Section
124.401,
subsection
1,
Code
2024,
is

amended
by
adding
the
following
new
paragraph:

NEW
PARAGRAPH
.
j.
A
person
who
causes
the
death
of
another
3
person
or
who
causes
serious
bodily
injury
to
another
person
as
4
described
in
paragraphs
“g”
and
“h”
may
be
charged
criminally
5
in
either
the
venue
where
the
controlled
substance
violation
6
occurred
or
in
the
venue
where
the
death
or
serious
bodily
7
injury
occurred.
If
two
prosecuting
agencies
are
seeking
to
8
file
criminal
charges,
the
venue
where
the
controlled
substance
9
violation
occurred
shall
have
priority.

EXPLANATION
11
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
12
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
venue
for
prosecution
of
a
14
controlled
substance
violation
resulting
in
the
death
or
15
serious
bodily
injury
of
another.
16
The
bill
provides
that
a
person
who
causes
the
death
of
17
another
person
or
who
causes
serious
bodily
injury
to
another
18
person
while
committing
a
violation
of
Code
section
124.401(1)
19
(prohibited
acts
——
manufacture,
delivery,
possession)
may
be
20
charged
criminally
in
either
the
venue
where
the
controlled
21
substance
violation
occurred
or
in
the
venue
where
the
death
or
22
serious
bodily
injury
occurred.
If
two
prosecuting
agencies
23
are
seeking
to
file
criminal
charges,
the
venue
where
the
24
controlled
substance
violation
occurred
shall
have
priority.
